HomeMy WebLinkAbout001 - 02/11/1955 - VACATING A PORTION OF COLORADO STREET AND AN ALLEY IN BLOCK 197 (EMERGENCY ORDINANCE) ORDINANCE NO 1 1955 BEING AN =E GENCY ORDINANCE VACATING A PORTIOY OF COLORADO STREET AND AN ALLEY IN BLOCK 197 IN THE CITY OF FORT COLLINS, COLORADO TriHERFAS, the sole owners of all the lands abutting on a portion of Colorado Street ana an alley in Block 197 in the City of Fort Collins, Colorado, have petitioned the City Council to cause the vacation of said portion of Coloraao Street and said alley which are more particularly described as follows, to-grit 1. COLORADO STREET That portion of Colorado Street lying between Lots 13, 15, 17, 193 21, 23 ana 25 and Lots 14, 16, 18, 20, 222 24 and 26 in Block 197 in the City of Fort Collins. 2. 4LLBY The alley lying immediately South of Lot 26 ana the West 42 4 feet of the alley lying immediately Sout�i of Lot 25 in block 197 in the City of Fort Collins, Colorado, in- cluaing the area of intersection between said alley and Colorado Street to the South line of said Block 197 This portion of Coloraao Street and the alley are coltiguous and are contained within the following aescribed boundary lines, to-wit Beginning at the Northeast corner of Lot 14 and ranning thence South 320 feet to the Southeast corner 1 of Lot 26, the-ice West 60 feet to the Southeest corner of Lot 26, thence 0outh 16.5 feet, thence East 262 4 feet to a point which is 16 5 feet South of the South line of Lot 25, thence 'North 16 5 feet to a point on the South line of saia Lot 25 which is 42.4 feet East of the Southwest corner of Lot 25, thence West 42 4 feet to the Southwest corner of Lot 25, thence North 320 feet to the Northeest corner of Lot 13, thence Vaest 60 feet to the point of beginning, all being within the boundary lines of Block 197 in the City of Fort Collins and zr accordance with the resubcavision plat of Block 197 dated January 3, 1903, r,ND, TTH=m S, saia portion of Colorado Street and said alley sought to be vacated have never been improvea or opensu to public travel and no public funds have been expended for construction or maintenance on said street or on said alley, and I 1,1M, EAS, the City Council is of the opinion that it will be to the best interest of saia City to vacate the said portion of Colorado Street ana the alley in Block 197 above described VOW, THEREFORE, BE IT ORDAINED BY TrM CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 That the portion of Coloraao Street lying between Lots 13, 15, 17, 19, 21, 23 ana 25, and Lots 14, 16, 185 203 22, 2L and 26 in Block 197 in the City of Fort Collins, end the alley lying immediately South of Lot 26 and the West 42.4 feet of the alley lying immediately South of Lot 25 in Block 197 in the City of Fort Collins, Colorado, including the area of intersection between said alley and Colorado Street to the South line of saia Block 197, all of which portion of Colorado Street ana the alley being contiguous and being contained within the following described boundary lines, to wit Begirsirg at the Northeast corner of Lot lb and running thence South 320 feat to the Southeast corner of Lot 26, thence West 160 feet to the Southwest corner of Lot 26, thence South 16 5 feet, thence East 262 4 feet to a point wnlch is 16.5 feet South of the South line of Lot 25, thence 7�orth 10 5 feet to a point on the South line of said Lot 25 Y•hich is 42 4 feet East of the Southwest corner of Lot 25, thence West 142 4 feet to the Soutar*est corner of Lot 25, thence North 320 feet to the Northwest corner of Lot 13, thence west 60 feet to the point of begiaru ng, all being rithin the bounaary lines of Block 197 in the City of Fort Collins and in accoraance with the resubdivision plat of Block 197 dated January 3, 1903, be ana the same are hereby vacated, abolished and abandoned pursuart to the Ordirances of the City of Fort Collins and the Statutes of the State of Colorado in such cases made and provined, and particularly unaer the provisions of Article 1, Chapter 120, Colorado Revised Statutes, 1953 Section 2. In the opinion of the City Council an emergency eX1sts for the preservation of public health, peace and safety, and tkis ordinance shall take effect upon its passage under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter, -2- ST M OF COLORADO) ) ss COUNTY OF LARIMER) I. HOUSE, City Clerk of the City of Fort Collins, do hereby certify and aeclare that the foregoing Ordinance, consisting of two sections, was duly proposed and read at length at a regular meeting of the City Council, hela on the llth day of February, A. D. 1955, and was duly adoptea ana ordered published in the Fort Collins Coloradoan, a gaily newspaper and the official newspaper of the City of Fort Collins, by the unanimous vote of all members of the City Council as an emergency ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter and on, to-wit the 15ttiiday of F ebrueir7 , A. D. 1955, said Ordinance No. 1 was duly published in the Fort Collins Coloradoan, a daily newspaper published in the City of Fort Collins, Cclor:.do. IN WITNESS WHMEOF, I have hereunto set my hana and affixed the seal of this City, this 15tn day of Febraary , A. D. 1955.
