HomeMy WebLinkAbout010 - 04/05/1962 - RELATING TO THE VACATION OF A CERTAIN EASEMENT IN MILLER BROTHERS SOUTH FOOTHILLS SUBDIVISION, FOURT ORDINANCE NO, 10 1961, BEING AN ORDDWXB RELATING TO THE VACATION OF A CERTAIN EASEMENT IN MILLER BROTHWmvfj SOUTH FOOTHILLS SUBDIVISION, FOURTH FILING WHEREA^a, .the plat of'Miller Brothers' South Foothills Subdivision, Fourth Filing, describers and dedicates a certain easement twelve (12) feet. in total width lying and being an area in mots 106 and 107 of said subdivision, six (6) feet :either,.side.of .a,ceuter, lintelwhich to the common boundary z between said Lots 106 and 107, extended; and WHEREAS, the owner of said Lots 106 and 107 in the above mentioned subdivision has petitioned the Council of the City of Fort Collins to cause the same to be vacated; and WHaust paid easement has never been used and the City of Fort. Collins has never expended.any public funds upon said easement and said easement to not needed for any public purpose; and WHEREAS, the w4nar of said lots has agreed to convey and dedicate a substitute easement, which said substitute easement has been approved by the City Engineer; and WHBRWO it further appears that the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by the vacation of such easement. NOW, THERFFORR, BE IT OHDAIRED.BX THE COUNCIL 01 THE CITY OF FORT COLLINS: Section 1.
