ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE
SOUTH SHIELDS STREET NINTH ANNEXATION TO THE CITY OF FORT
COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURIS-
DICTION THEREOF PURSUANT TO THE AUTHORITY CONTAINED IN
ARTICLE 11, CHAPTER 139, COLOAADO MVISED STATUTES, 1953
WHEREAS, heretofore a written petition was presented to the Council
of the City of Fort Collins in substantial compliance with the provisions -of
Article 11 Chapter 139 Colorado Revised Statutes, by the owners of more than
fifty per cent (507) of the area and who comprise the majority of landowners
residing in the area of land embraced in what is known as the South Shields
Street Ninth Annexation to the City of Fort Collins, wherein and whereby said
petitioners petitioned the City of Fort Collins for annexation of all the
territory embraced in what is known as the South Shields Street Ninth Annexation
to the City of Fort Collins, Colorado, comprising the lands shown in the plat
thereof attached to said petition and more particularly described as hereinafter
set forth, and
WHEREAS, said petition was accepted by the Council of the City of
Fort Collins by resolution passed and adopted on February 27 1964, and
WHEREAS, notice for hearing on the 9th day of April A D 1964, on
an ordinance approving the annexation of said territory and including the same
within the limits and jurisdiction of the City of Fort Collins was duly published
as provided by law and
WHEREAS the Council of the City of Fort Collins has found that the
petition and the documents thereto attached meet the requirements of Article 11,
Chapter 139 Colorado Revised Statutes, 1953, and
WHEREAS no proceedings for an election to determine the question of
annexation have been initiated by written counter-petition as provided by law
and no objection to annexation having been made
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That after due consideration of the petition for annexation
the petition for the annexation of all the territory in what is known and described
as the South Shields Street Ninth Annexation to the City of Fort Collins Colorado,
as shown by the plat thereof annexed to said petition and which is more particularly
described as follows, to-wit
Parcel No 1 A tract of land situate in the NE'k of the SEk
of Section 15, Township 7 North, Range 69 West of the 6th
P M in the County of Larimer and State of Colorado which
considering the East line of said SE' as bearing due South
and with all bearings contained herein relative thereto,
is contained within the boundary lines which begin at a
point which bears S 313 50 feet from the East k corner of
said Section 15 and run thence South 348 83 feet to the SE
corner of the Nk of the NFA of the SEk of said Section 15
thence S 15 00 feet thence W 280 00 feet thence N 17 24
feet to a point on the S line of the Nk of the M of the
SEk of said Section 15 thence N 89 32'30 W 1048 69 feet
along said South line to the West line of the E'k of the SEk
of said Section 15, thence N 00 03 W 346 72 feet along said
West line, thence S 89 34' East 1328 99 feet to the point of
beginning containing 10 713 acres, more or less AND
Parcel No 2 A tract of land located in Section 15, Town-
ship 7 North, Range 69 West of the 6th P M in the County
of Larimer and State of Colorado, more particularly described
as follows Considering the East line of the SEA of said
Section 15 as bearing due South and with all bearings contained
herein relative thereto, begin at the NE corner of the Sk of
the NE'k of said SEk and run thence South 15 00 feet thence
West 280 00 feet thence North 17 24 feet to the North line
of said South � of the NE'k of the SEk thence along said
line S 89 32'30 East 280 00 feet to the point of beginning
containing 0964 acres, more or less
be accepted and approved and that said territory be annexed and made a part of
the City of Fort Collins and be included within the limits and jurisdiction of
the City of Fort Collins with Parcel No 1 as a 'C Residential District and
with Parcel No 2 as an A Residential District, and that the City Clerk be
and he is hereby authorized and directed to prepare certified copies of this
ordinance, to each of which shall be attached a plat of said South Shields
Street Ninth Annexation to the City of Fort Collins Colorado and shall file
a copy thereof in the office of the Clerk and Recorder of the County of Larimer
and another copy thereof in the office of the Clerk of the City of Fort Collins
together with a certified copy of said petition and another copy of said petition
and approving ordinance with the Secretary of State of the State of Colorado
Section 2 That in accepting and approving the plat of the South
Shields Street Ninth Annexation to the City of Fort Collins, the City of Fort
Collins does not assume obligations respecting the construction of water mains
sewer lines gas mains electric light lines or other services or utilities with
respect to service of said addition except as may be required and provided by

the owners of the property within the limits of said addition in compliance
with the terms and provisions of Chapter 15, Code of Ordinances of the City
of Fort Collins Colorado, 1958, as amended relating to local and public
improvements
Intooduced, considered favorably on first reading and ordered pub-
lished this 9th day of April A D , 1964, and to be presented for final passage
on the 7th day of May, A D , 1964
