BEING AN ORDINANCE RELATTA ,M VACATION OF
A PORTION OF THE STREET DESIGNATED AS CITY PARK
AVENUE IN THE CITY OF FORT COLLINS COLORADO
WHEREAS, John J Nicol and Elsie K Nicol are the owners of
Lot 1 in Block 2, City Park Heights, according to plat filed April 9,
1907, in the City of Fort Collins, Colorado and they are the purported {
owners of the following
Beginning at the Northeast corner of said Lot 1 in Block
2, City Park Heights according to plat filed April 9,1907
in the City of Fort Collins, Colorado, thence East 10
feet, thence South 190 feet, thence West 10 feet, thence
North 190 feet to the point of beginning which 10 foot
by 190 foot strip which is situated in what was originally
dedicated to be City Park Avenue, and
WHEREAS, on December 2, 1931 the Board of County Commissioners
of Larimer County Colorado purportedly vacated said 10 foot by 190 foot
strip but that said vacation was defective, and
WHEREAS, City Park Avenue is not used as a public street and
has not been used as a public street for many years, and
WHEREAS, it appears that the rights of the inhabitants of the
City of Fort Collins, Colorado will in no way be prejudiced by vacating
the said 10 foot by 190 foot parcel of land;
Now, THEREFM, be it ordained by the Council of the City of
Fort Collins;
That portion of City Park Avenue described as
Beginning at the Northeast corner of Lot 1, in Block 2,
City Park Heights according to plat filed April 9, 1907
in the City of Fort Collins, Colorado, thence East 10 feet,
thence South 190 feet, thence West 10 feet, thence North
190 feet to the point of beginning,
be and the same hereby is vacated, abolished and abated
Introduced, considered favorably on first reading and ordered pub-
lished this 24th day ofSept_ember, 1964, and to be presented for final
