HomeMy WebLinkAbout041 - 09/16/1965 - ANNEXING PROPERTY KNOWN AS THE WEST PROSPECT SECOND ANNEXATION ORDINANCE NO 41. , 1965, BEING AN ORDINANCE ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE WEST PROSPECT SECOND ANNEXATION TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11, CHAPTER 139, COLORADO REVISED STATUTES, 1953 WHEREAS, heretofore a written petition was presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11, Chapter 139, Colorado Revised Statutes, 1953, by the owners of more than fifty per cent (507) of the area and who comprise the majority of landowners residing in the area of land embraced in what is known as the West Prospect Second Annexation to the City of Fort Collins, wherein and whereby said petitioners petitioned the City of Fort Collins for annexation of all the territory embraced in what is known as the West Prospect Second Annex- ation to the City of Fort Collins, Colorado, comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereinafter set forth, and WHEREAS, said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on July 15, 1965, and WHEREAS, notice for hearing on the 26th day of August, 1965, on an ordinance approving the annexation of said territory and including the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents thereto attached meet the requirements of Article 11 Chapter 139 Colorado Revised Statutes, 1953, and WHEREAS, no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annex- ation, the petition for the annexation of all the territory in what is known and described as the West Prospect Second Annexation to the City of Fort Collins, Colorado as shown by the plat thereof annexed to said petition and which is more particularly1described as follows, to-wit A part of the North � of Section 21 and the SEk of Section 16 of Township 7 North Range 69 West of the Sixth P M which considering the North line of said Section 21 as bearing S 89 41' E and with all bearings contained herein relative thereto is contained within the boundary lines which begin at the North k corner of said Section 21 and run thence S 89*41' E 648 65 feet, thence N 00 06'30 W 572 65 feet, thence N 89 41' W 328 65 feet, thence N 00 06 30 W 746 20 feet, thence S 89 41' E 746 16 feet, thence S 00 06 30 E 716 20 feet, thence S 89 41 E 82 49 feet, thence S 00 06 30 E 632 65 feet thence N 89 41 W 446 26 feet, thence S 00*19 W 450 00 feet, thence N 89 41' W 304 00 feet, thence N 00*19 E 450 00 feet, thence N 89 41' W 1689 03 feet, thence S 00*46 E 1346 94 feet along the particularly described as follows Begin at a point which bears S 89041' E 708 65 feet from the South k corner of said Section 16 and run thence N 00 06 30 W 572 65 feet thence S 89 41' E 315 00 feet, thence S 00006'30 E 572 65 feet, thence N 89 41 W 315 00 feet to the point of beginning be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included in the following zoning districts that part of the above described property more particularly described as follows A tract of land situate in the SEk of Section 169 Town- ship 7 North, Range 69 West of the Sixth P M , County of Larimer, State of Colorado, which considering the South line of said SEk as bearing S 89*41' E and with all bearings contained herein relative thereto is con- tained within the boundary lines which begin at a point which bears S 89041' E 648 65 feet, and again N 00 06 30 W 572 65 feet, and again N 89 41' W 328 65 feet, and again N 00 06 30 W 746 20 feet, and again S 89*41 E 246 16 feet from the Sk corner of said Section 16 and run thence S 00 06 30 E 746 20 feet, thence S 89*41 E 250 00 feet, thence N 00 06'30 W 746 20 feet, thence N 89 41' W 250 00 feet to the point of beginning, be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction of the City Range 69 West of the Sixth P M , County of Larimer, State of Colorado, which considering the North line of said NWk as bearing S 89*41' E and with all bearings contained herein, relative thereto, is contained within the boundary lines which begin at a point which bears S 89 41 E 556 00 feet from the Northwest corner of said Section 21 and run thence S 89 41' E 315 00 feet, thence S 00*46 E 252 00 feet thence S 18*37' W 62 50 feet, thence N 78 18' W 205 00 feet, thence N 72 40 W 114 65 feet thence along the arc of a 75 34 foot radius curve to the left a distance of 48 29 feet, the long chord of County of Larimer State of Colorado, which considering the West line of said NWT as bearing N 00 35' W and with all bearings contained herein relative thereto, is con- tained within the boundary lines which begin at a point which bears S 00 35 E 655 85 feet from the Northwest corner of said Section 21, and run thence N 89 42' E 212 07 feet thence along the arc of a 49 33 foot radius curve to the left a distance of 46 28 feet, the long chord of which bears N 62°49'30 E 44 60 feet, thence S 35 42 E 117 00 feet thence S 29*20' E 221 00 feet thence S 52 30 W 77 00 feet thence S 89 42 W 364 00 feet to a point on the West line of said NWk thence N 00 35 W 315 00 feet to the point of beginning, be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction of the City of Fort Collins as a C Residential District, that part of the above described property more particularly described as follows A tract of land situate in the NWk of Section 21, Town- ship 7 North, Range 69 West of the Sixth P M , County of Larimer, State of Colorado, which considering the West line of said NWk as bearing N 00*35' W and the North line of said NWT as bearing S 89°41 E and with all bearings contained herein relative thereto is contained within the boundary lines which begin at the Northwest corner of said Section 21 and run thence S 00 35 E 655 85 feet thence N 89 42' E 212 07 feet, thence along the arc of a 49 33 foot radius curve to the left a distance of 46 28 feet, the long chord of which bears N 62 49'30 E 44 60 feet thence N 35057 E 486 79 feet thence along the arc of a 75 34 foot radius curve to the left a distance of 48 29 feet, the long chord of which bears N 17035'30 E 47 46 feet, thence part of the City of Fort Collins and be included within the limits and jurisdiction of the City of Fort Collins as a D Commercial District, and that the remainder of said property be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction of the City of Fort Collins as an A Residential District,I and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance, to each of which shall be attached a plat of said West Prospect Second Annexation to the City of Fort Collins, Colorado and shall file a copy thereof in the office of the Clerk and Recorder of the County of Larimer, and another copy thereof in the office of the Clerk of the City of Fort Collins, together with a certified copy of said petition and another copy of said petition and approving ordinance with the Secretary of State of the State of Colorado Section 2 That in accepting and approving the plat of the West Prospect Second Annexation to the City of Fort Collins, the City of Fort Collins does not assume obligations respecting the construction of water mains, sewer lines, gas mains electric light lines or other services or utilities with respect to service of said addition, except as may be required and provided by the owners of the property within the limits of said addition in compliance with the terms and provisions of Chapter 15 Code of Ordinances of the City of Fort Collins, Colorado 1958, as amended, relating to local and public improvements Introduced,
