HomeMy WebLinkAbout011 - 02/09/1967 - SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY THE QUESTION OF AMENDING SECTION 7, ARTICLE II OF T .. l ORDINANCE NO. 119 1967 BEING AN ORDINANCE SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY OF FORT COLLINS THE QUESTION OF AMENDING SECTION 7, ARTICLE II OF THE CITY CHARTER AND DECLARING AN EMERGENCY. WHEREAS, Section 5 of Article XX of the Constitution of the State of Colorado, provides that the City Council may on its own -initiative submit any charter amendment at any general municipal election held not less than thirty days after the effective date of the ordinance submitting such question to the voters, and WHEREAS, a general city election will be held on Tuesday, the 41h day of April, A D., 1967, and WHEREAS, it is the opinion of the City Council that there should be submitted to the qualified voters of the City of Fort Collins the matter of amending Section 7, Article II of the Charter of the City of Fort Collins NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1. That there is hereby submitted to the qualified voters of the City of Fort Collins at the general election to be held on Tuesday, the a day of April, A.D., 19679 the question of whether or not Section 7, Article II of the Charter of the City of Fort Collins should be amended by adding the following paragraph thereto "The City Council may enact any ordinance which adopts any Code by reference in whole or in part provided that before adoption of such ordinance the Council shall hold a public hearing thereon and notice of the hearing shall be published twice in the newspaper of general circulation, published in the City, one of such publications to be at least eight days preceding the hearing and the other at least fifteen days preceding the hearing. Such notice shall state the time and place of the hearing and shall also state that copies of the code to be adopted are on file with the City Clerk and open to public inspection The notice shall also contain a description which the Council deems sufficient to give notice to persons interested as to the subject matter of such code and the name and address of the agency by which it has been promulgated The ordinance adopting any such code shall set forth in full any penalty clause in connection with such code " Section 2 In the opinion of the City Council an emergency exists for the actual preservation of the public peace, health, safety and property and this ordinance shall take effect upon its passage under and by virtue of the authority contained in Sections 6 and 7 of Article II of the Charter of the City of Fort Collins. Introduced, read at length and adopted by the unanimous vote of all members of the City Council at a regular meeting held this 91h day of February, A.D , 1967. Ms& i 1 or ATTEST City Clenk -2- STATE OF COLORADO) ) ss COUNTY OF LARIMER) I, MILES F HOUSE, City Clerk of the City of Fort Collins, do hereby certify and declare that the aforesaid Ordinance, consisting of two sections, was duly proposed and read at length at a regular meeting of the City Council held on the 9th day of February, A D. 1967, and was duly adopted and ordered published in the Fort Collins Coloradoan, a daily newspaper and official newspaper of the City of Fort Collins, by the unanimous vote of all members of the City Council, as an Emergency Ordinance, in accordance with the provisions of Section 6 and 7 of Article II of the City Charter, and thereafter and on, to-wit the lhth day of Febmrq , A. D 1967, said Ordinance No 11 was duly published in the Fort Collins Coloradoan, a daily newspaper published in the City of Fort Collins, Colorado IN WITNESS WHEREOF, I have hereunto set n4' hand and affixed the seal of said City, this 14th day of FebrMT7 , A D 1967 City Clerk
