BEING AN ORDINANCE AMENDING CHAPTER 4 OF THE CODE OF
ORDINANCE OF THE CITY OF FORT COLLINS, COLORADO, 1958,
AS AMENDED (SECTIONS 4-15 AND 4-18 THEREOF) RENTING TO
BUILDING CONTRACTORS AND LICENSES TBEREFORE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
Section 1. That Section 4-15 of the Code of Ordinances of the City of Fort
Collins, Colorado, 1958, be and the same hereby is amended by deleting from the
last sentence in the first paragraph of said section the following words "and
is financially and morally responsible"
Section 2 That Section 4-18 of the Code of Ordinances of the City of Fort
Collins, Colorado, 1958, as amended, be and the same hereby is amended to read
as follows
"Section 4-18 Duties and Responsibilities of the Contractor -
Revocation of License
Any contractor licensed hereunder shall be responsible for
all work included in his contract whether or not such work is done
by him directly or by a subcontractor. He shall be responsible
for all funds or property received by him for prosecution or
completion of a specific contract or for a specific purpose.
The Building Inspector may upon his own motion and shall
upon the verified complaint in writing of any person, convene
the Building and Contractors Licensing Board Jbr the purpose of
holding a hearing to determine whether or not any license issued
hereunder should be revoked The license holder shall be given
notice in writing of the meeting of such board, such notice to
be served upon the license holder by registered mail, postage
prepaid, mailed to his last known post office address at least
five days in advance of the time of such meeting Such notice
shall state the time and place of the meeting and shall advise
the license holder at whose instance the complaint was made and
the specific charges relied upon for suspension or revocation of
such license
The Budding and Contractors Licensing Board shall have the
power to suspend or revoke any license if the holder thereof
commits any one or more of the following acts or omissions
A Willful and deliberate disregard and violation
of the building code of the City of Fort Collins or
failure to comply with any of the zoning ordinances or
health and safety ordinances of the City or any lawful
order of the Building Inspector if
B Misrepresentation of the material fact by a
license holder in obtain-in a license
C Fraudulent use of a license to obtain permits for
another or lending of a license for any purpose
D Failure to obtain a building permit for any work as
required by this code
E. Adjudication of insanity or incompetency by any
competent authority
If any license is revoked hereunder, the license holder shall
not be granted another license under this code for at least twelve
months after the date of revocation In suspending a license hereunder
the Building and Contractors Licensing Board shall state the period and
terms of the suspension."
