BEING AN ORDINANCE VACATING AN ALLEY IN
BLOCK 123 IN THE CITY OF FORT COLLINS
WHEREAS the owners of property adjacent to same have
requested that the alley in Block 123 be vacated and
WHEREAS such block is the site of a proposed hotel complex
and it will be necessary to vacate said alley in order to allow
that development and
WHEREAS because of the ownership and use of the property
adjoining said alley the alley is no longer needed for munici-
pal purposes nor will it be needed for municipal purposes in
the future except to the extent the same is needed for existing
utility installations and
WHEREAS it appears that the rights of the citizens of
the City of Fort Collins will in no way be prejudiced by the
vacation of said alley
NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF FORT COLLINS that the alley in Block 123 in the City of
Fort Collins be and the same hereby is abolished vacated
and abated provided however that there is reserved hereby
a right of way and easement for utilities and utility lines
as the same now exist in said alley and provided further that
at such time as such utilities are relocated this reservation
shall expire and said alley shall be completely vacated
Introduced considered favorably on first reading and
ordered published this 1st day of July A D 1975 and to be
presented for final passage on the 18th day of November A D 1975
