HomeMy WebLinkAbout040 - 04/19/1977 - AMENDING SECTION 118-831(3)(B)(10) OF THE CITY CODE RELATING TO LANDSCAPING REQUIREMENTS IN A PLANNE 01 U f NANCL NO _40 , 1977 BJ'ING AN 01 DINANCC AMENDINC SECTION 11R-83) ( 3) (b) ]10] OF 111F, COD(', 01 711E CI1Y OP ) 01 l COJ I 1 NS BEING A PORTION OF 7111; ZONING ORDINANCh RELATING 70 JANDSCAPING RPQUIREMLNTS IN A PLANNED UNIT DEVELOPMENT BP IT ORDAINED BY THE COUNC114 OF THL CITY OF FORT COLLINS That Section 118-83F (3) (b) [10] of the Code of the City of Port Collins be, and the samc hereby is, amended to read as follows ' [10] No building permit shall be issued for construction of any building on any portion of a unit development until the landscaping required by the final landscape plan is in place of a bond , cash deposit or equivalent is deposited with the Director of Finance conditioned on ind guaranteeing the installation of all landscaping shown on the appioved landscape plan Such bond cash deposit or equivalent shall be in the amount of one hundred twenty-five percent (125 ) of the estimated cost of the landscaping improvements determined by an executed contract to install such landscaping or by adequate appraisals of such cost Such bond cash deposit or equivalent shall further guarantee the continued maintenance and replacement of the landscaping for a period of two (2) years after installation, but the amount of the same shall be reduced after installa- tion is completed to twenty-five percent (25a) of the actual cost of such landscaping If the required landscaping is already installed prior to application for a building permit a bond in the amount of twenty- five percent (25e) of the actual cost of the landscaping guaranteeing continued maintenance and replacement of the same for a period of two (2) years shall be.required as a condition of i_ suance of the building permit Any bond, cash deposit or equivalent deposited pursuant to this requirement shall be relcabed upon certificition by the Building Inspector that the required landscaping program has been completed and maintaincd in accordance with the requirements of the bond If any landscaping required pursuant to this -ect3on is not maintained in accordance with the requirements of the final plan, such failure to maintain the landscaping shall be a violation of this ordinance enforceable by action in the Municipal Court of the City of loll Collins or the County or District Court of Larimer County, Colorado " Introduced, considered fdvorably on first reading, and ordered publi�hcd this 29th day of March , A D. 1977, and to he presented foi final pdbsdge on the 19th day of April A.D. 1977. f ATTEST Mayor City Clerk Passed and adopted on final reading this 19th day of April , A.D. 1977.
