21-51 OF THE CODE OF ORDINANCES OF THE CITY OF FORT COLLINS COLORADO, 1958, AS AMENDED AND ADDING SECTION 21-57 TO SAID CODE OF ORDINANCES AND RELATING TO ELECTRIC SERVICE WHEREAS, the City of Fort Collins is the owner and operator of a municipal light and power system and has heretofore adopted a schedule of rates and rules and regulations concerning electric service and WHEREAS, the City of Fort Collins has caused to be made an engineering report on electric rates by C H Hoper and Associates, and WHEREAS, the Director of Utilities and the City Manager have recommended that a new and revised schedule of rates be adopted, and the City Council is of the opinion that the recommended rates are fair and reasonable based upon actual cost of service NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That Section 21-51 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended as follows A By deleting from said Section 21-51, Schedule 1 _m4nd by substituting therefor the following SCHEDULE 1 RESIDENCE SERVICE Applicability To residential customers for all domestic uses in private residences or individually metered apartments Incidental use for other pur- poses is permitted provided that the customer s load and/or use is predomi- nantly as specified above Rate First 35 KWH used per month, per KWH $0 05 Next 40 KWH used per month, per KWH 03 Next 75 KWH used per month, per KWH 015 All additional KWH used per month, per KWH 0125 Minimum Minimum charge per meter per month $1 25 Contract period and conditions All contracts under this schedule shall be for a minimum period of thirty (30) days and thereafter until terminated All customers not permanent residents not owning their own residence, are required to make a deposit of $10 00 before meter is installed This will be held by the Department until the contract is cancelled or proof of ownership is established This rate may not be applied to more than three (3) apartments, or to hotels, motels, fraternities, sororities, clubs, hospitals, or rest homes All bills shall be due and payable ten (10) days from date of billing and delinquent thirty (30) days from date of billing Rules and Regulations Customer desiring service under this schedule shall apply at the office and agree to the provisions as required by the City, and make the residence subject to inspection by the Department if so required Service under this schedule will be in accordance with the general provisions of the Service Rules and Regulations of the Department, as approved by the City Council B By deleting from said Section 21-51, Schedule 2 and by substituting therefor the following SCHEDULE 2 BUSINESS SERVICE Applicability To business, commercial, and non-residential customers for general lighting and incidental single phase power Available in corporate limits of the City of Fort Collins and suburban fringe Single meter rate for the use of one customer and not for resale to others -2- Rates First 50 KWH used per month, per KWH $0 05 Next 100 KWH used per month, per KWH 04 Next 850 KWH used per month, per KWH 03 Next 19,000 KWH used per month, per KWH 02 Balance 0175 Minimum Minimum monthly charge per meter per month $1 00 Payment The above rates are net Bills for electric service are due and payable within ten (10) days from date of bill Contract Period All contracts under this schedule shall be for a minimum period of thirty (30) days and thereafter until terminated Rules and Regulations The above rules and regulations are subject to the provisions as approved by the City Council Buildings and service to be subject to inspection by the Department and City Building Inspector Deposit charge on business meters will be made in accordance with the nature of the business and the amount of current that may be used This amount may be up to approximately two months bill Service under this rate is available for lighting and miscellane- ous small appliances Service under this schedule is for commercial customers including clubs, fraternities, sororities churches lodges, hotels apartments, rooming houses, tourist camps, and multiple dwellings where more than one dwelling or more than one living quarters is served through one meter Service under this schedule will be in accordance with the general provisions of the Service Rules and Regulations of the Department as approved by the City Council -3- C By deleting from said Section 21-51 Schedule 3 therein D By deleting from said Section 21-51 Schedule 4 and by substituting therefor the following SCHEDULE 4 GENERAL SECONDARY POWER SERVICE Applicability Available for alternating current power service metered at the voltage of City s established secondary distribution system Rate (Net) First 20 KWH used per month per KW demand but not less than for the first 60 KWH used, per KWH $0 045 Next 40 KWH used per month per KW of demand but not less than for the next 120 KWH used, per KWH 04 Next 140 KWH used per month per KW of demand but not less than for the next 420 KWH used, per KWH 02 All additional KWH used per month per KWH 0125 Minimum Net monthly minimum charge per KW of demand $1 00 Not less per meter, per month, than $2 00 Determination of Billing Demand The highest rate of use in KW during any 15-minute interval of the billing period, as determined at the utility s option by demand meter, periodic load test, or negotiation Service under this schedule will be in accordance with the general provisions of the Service Rules and Regulations of the Department as approved by the City Council Bills for electric service shall be due and payable within ten (10) days from date of bill E By deleting from said Section 21-51 Schedule 6 therein F By deleting from said Section 21-51, Schedule 7 therein G By deleting from said Section 21-51, Schedule 8 therein -4- H By deleting from said Section 21-51, Schedule 9 therein I By deleting from said Section 21-51, Schedule 10 and by substituting therefor the following SCHEDULE 10 SPECIAL AREA FLOOD LIGHTING Applicability Available in corporate Limits of the City of Fort Collins and suburban fringe areas, providing lines are constructed near the location to be served Rate Size Single Twin 175 Watt Mercury Vapor $3 50/mo $6 00/mo 250 Watt Mercury Vapor 4 25/mo 7 25/mo 400 Watt Mercury Vapor 6 00/mo 10 00/mo 700 Watt Mercury Vapor 9 25/mo 15 00/mo 1,000 Watt Mercury Vapor 12 50/mo 20 00/mo Contract Period and Conditions These rates apply to special area floodlighting installed and maintained at the expense of the Light and Power Department Floodlighting by Mercury Vapor Lamp and fixture with photocell control for dusk to dawn operation All contracts under this schedule shall be for a minimum period of twelve (12) months and thereafter until terminated All bills for electric service shall be due and payable within ten (10) days from date of billing J By adding to said Section 21-51, the following schedule SCHEDULE 11 COMBINED LIGHT AND POWER SERVICE APPLICABILITY Applicability Available in corporate limits of the City of Fort Collins This is a single meter rate for use of one customer and not for resale to others -5- Availability This rate is available only at 120/208 volts 3 phase 4 wire or 277/480 volts 3 phase 4 wire Rate First 50 KWH used per month, per KWH $0 05 Next 100 KWH used per month, per KWH 04 Next 850 KWH used per month, per KWH 03 Next 9,000 KWH used per month, per KWH 025 Balance KWH used per month, per KWH 02 Minimum Minimum monthly charge per meter per month $5 00 Payment Bills for electric service shall be due and payable within ten (10) days from date of bill K By adding to Schedule M of said Section 21-51 after the words and figures Pedestrian Activated Traffic Signal - $297 50 the following words and figures For traffic signals other than the 4-Way conventional type, rates will be determined by cost analysis by the Department L By changing, deleting, and adding to the Electric Rates General Service Rules and Regulations contained in said Section 21-51 as follows (1) By adding to Section 1 (b) thereof after the words and figures 2400 volts the following words and figures 4160 volts and 13,800 volts and by changing the period ( ) after 2400 volts to a comma ( ) (2) By adding a subparagraph (c) to Section 1 thereunder as follows Kc) Service voltages other than those above listed must be approved in advance by the Light and Power Department (3) By deleting from said Electric Rates General Service Rules and Regulations, Section 16 thereof (4) By renumbering Section 17 thereof and changing it to Section 16 -6- (5) By deleting therefrom Section 18 Section 2 That there is hereby added to the Electric Service Ordinance Section 21-57 as follows Section 21-57 Lien on Property All light, heat, and power charges made pursuant to this Ordinance shall be a lien upon the property to which service is delivered from the date said charges become due until such charges are paid The owner of every building, premise, lot, or house shall be liable for all service delivered to his premises, which lien or liability may be enforced by the City by action at law or suit to enforce the lien In case a tenant in possession of any premises or buildings shall pay said charges, it shall relieve the landowner from such obligation and lien but the City shall not be required to Look to any person whatsoever other than the owner for the payment of such charges No change of ownership or occupation shall affect the application of this ordinance and the failure of any owner to learn that he purchased property against which a lien for light heat, and power service exists shall in no way affect his liability for such payment in full The amount due and in default shall, in addition to the right of enforcement by disconnection of such service, become a lien on the property and premises served from the date the same became due and payable and said delinquent payments may be enforced by assessment upon the property and premises so served and certificates thereof to the County Treasurer for collection under and in pursuance of the authority and procedure provided in Chapter 15 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended Section 3 The rates set forth in this ordinance shall become effective the first billing date following January 1 1966 Until such date, present rates shall remain in effect Introduced, considered
