HomeMy WebLinkAbout009 - 02/26/1970 - AMENDING CHAPTER 19 OF THE CITY CODE CREATING A NEW ZONE TO BE KNOWN AS THE R-M-P, MEDIUM DENSITY PL ORDINANCE NO: �, 1970, BEING AN ORDINANCE AMENDING CHAPTER 19 OF THE CODE OF ORDINANCES OF THE CITY OF FORT COLLINS, COLORADO, 1958, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE AND CREATING A NEW ZONE TO BE KNOWN AS THE R-M-P, MEDIUM DENSITY PLANNED RESIDENTIAL DISTRICT AND CREATING A NEW ZONE TO BE KNOWN AS THE R-L-M, LOW DENSITY MULTIPLE FAMILY DISTRICT AND RELATING TO CHANGING THE ZONING MAP OF THE CITY OF FORT COLLINS SO AS TO PLACE CERTAIN PROPERTY IN SAID ZONES: BE IT ORDAINED BY THE COUNCIL OF THE CIT,Y ,OF FORT COLLINS: Section 1 . That Chapter 19 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended by adding a new section after Section 19-33 of said Chapter to read as follows: "Section 19-33A. R-M-P,Medium Density Planned Residential District (medium density areas planned as a unit to provide a variation in use and building placements 7. 1 . Uses permitted. 1 Any use permitted in the R-L, Low Density Residential District, subject to all use requirements set forth for the R-L, Low Density Residential District; and (2) Any use permitted in the R-M, Medium Density Residential District, subject to being shown on a unit development plan as defined, processed and approved according to Section 19-44 of this Ordinance. 2. Minimum area of lot, minimum width of lot, minimum front yard, minimum rear yard, and minimum si e yar . The same as specified for the R-L, Low Density Residential District, except where buildings are located on a unit development plan, as defined, processed and approved according to Section 19-44 of this Ordinance, in which case the yard, lot, parking, and other requirements required of a planned unit development in the R-M, Medium Density Residential Zone shall apply." Section 2. That Chapter 19 of the Code of Ordinances of the City of Fort Collins, Colorado 1958, as amended, be and the same hereby is amended by adding a new section after Section 19-30 as follows: "Section 19-30A. R-L-M, Low Density Multiple Family District (areas containing low density multiple family uses) . 1 . Uses permitted. 1 Any use permitted in the R-L, Low Density Residential District, subject to all use requirements specified for the R-L, Low Density Residential District; and (2) Two family dwellings and multiple family dwellings up to and including four family units. 2. Minimum areaof lot. Three times the total floor area of the buildings; but not less than 6,000 sq. feet for a one family or two family dwelling, and 9,000 sq. feet for a multiple family dwelling. 3. Minimum width of lot. 60 feet for a one family or two family dwelling and 75 feet for a multiple family dwelling. 4. Minimum front yard (minimum distance of any building from the front lot line). 30 feet. 5. Minimum rear yard (minimum distance of any building from the rear lot line) . 15 feet. 6. Minimum side yar, (minimum distance of any building from each side lot line) . 1 foot for each 3 feet, or fraction thereof, of building height; except that no side yard shall be less than 7 feet for any residential use, nor less than 25 feet for any school or church. 7. Minimum off-street parking. For each dwelling unit, two spaces; and for each school or church one space for every five seats in the auditorium or place of assembly. 8. Unit developments. Areas planned as a unit to provide variation in building placement which are. located on a unit development plan as defined, processed, and approved according to Section 19-44 may vary requirements for minimum area of individual lots, width of lot, front yard, rear yard and side yard as required above." Section 3. That Section 19-27 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended by changing sub-Section 1 thereof to read as follows: "1 . Establishment of Zoning Districts. In order to carry out the purposes of this Ordinance, the City of Fort Collins, Colorado, is hereby divided into the following zoning districts: (1 ) R-E, Estate Residential District (2) R-L, Low Density Residential District (3) R-L-M, Low Density Multiple family District. (4) R-M, Medium Density Residential District. (5) R-H, High Density Residential District. (6) R-P, Planned Residential District. (7) R-M-P, Medium'Density Planned Residential District. (8) M-L, Low Density Mobile Home District. (9) M-M, Medium Density Mobile Home District. (10) B-P, Planned Business District. (11 ) B-L, Limited Business District. (12) B-G, General Business District. (13) C, Commercial District. (14) I-L, Limited Industrial District. (15) I-G, General Industrial District." Section 4. That the Zoning District Map adopted by Chapter 19 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is changed and amended in order to place the following described property in the City, to-wit: A tract of land situate in Section 25, Township 7 North, Range 69 West of the Sixth P.M. , which, considering the West line of said Section 25 as bearing S. 00°00'45" E. and with all bearings contained herein relative thereto, begin at the center quarter corner of said Section 25, and run thence S. 89°47'08" W. 370.92 feet; thence N. 00*13' W. 100.08 feet; thence along the arc of a 15 foot radius curve to the right a distance of 23.56 feet, the long chord of which bears N. 44°47' E. 21 .21 feet; thence N. 89"47' E. 365.82 feet; thence along the arc of a 765.93 foot radius curve to the left -a distance of 353.58 feet, the long chord of which bears N. 76°33'30" E. 350.45 feet; thence N. 63°20' E. 50.00 feet; thence along the arc of a 15 foot radius curve to the right a distance of 24.09 feet, the long chord of which bears S. 70039' E. 21 .59 feet; thence along the arc of a 570'.36 foot radius curve to the right a distance of 428.80 feet, the long chord of which bears S. 03°05'45" E. 418.77 feet; thence N. 64°11 ' 05" W. 106.60 feet; thence N. 11°45' E 115.00 feet; thence N. 17038' W. 50.97 feet; thence S. 89047'08" W. 350.00 feet to the point of beginning; ALSO A tract of land situate in Section 25, Township 7 North, Range 69 West of the Sixth P.M. , which, considering the West line of .said Section 25 as bearing S. 00000'45" E. and with all bearings contained herein relative thereto, begins at a point which bears N . 89°47'08" E. 2281 .00 feet from the West quarter corner of said Section 25, and run thence- N. 00°13' W. 100.08 feet; thence along the arc of a T5 foot radius curve to the right a distance of 23.56 feet, the long chord of which bears N. 44°47' E. 21 .21 feet; thence N. 89°47' E. 365.82 feet; thence along the arc of a 765.93 foot radius curve to the left a distance of 353.58 feet, the long chord of which bears N. 76033'30" E. 350.45 feet; thence N. 63020' E. 50.00 feet; thence along the arc of a 15 foot radius curve to the right-a distance of 24.09 feet, the long chord of which bears S. 70°39' E. 21 .59 feet; thence along the arc of a 570.36 foot radius curve to the right a distance of 521 .96 feet, the long chord of which bears S. 01035' W. 503.93 feet; thence S. 27048' W. 735.49 feet; thence along the arc of a 819.47. foot radius curve to the left a distance of 397.61 feet, the long chord of which bears S. 13054'. W. 393.72 feet; thence South 80.40 feet; thence along the arc of a 15 foot radius curve to the right a distance of 23.50 feet, the long chord of which bears S. 44052'45" W. 21 .17 feet; thence S. 89°45'30" W. 569.85 feet; thence along the . arc of a 15 foot radius curve to the right a distance of 23.56 feet, the long chord of which bears N. 45014'30" W. 21 .21 feet; thence N. 00°14'30" W. 150.00 feet; thence along the arc of a 1014.57 foot radius curve to the right a distance of 298.23 feet, the long chord of which bears N. 08010'45" E. 297.15 feet; thence N. 16036' E. 575.14 feet; thence along the arc of a 1419.21 foot radius curve to the left a distance of 416.55 feet, the long chord of which bears N. 08011 '30" E. 415.05 feet to the point of beginning; I - - into the R-M-P, Medium Density Planned Residential District created by this Ordinance. Section 5. That the Zoning District Map adopted by Chapter 19 of the Code of Ordi- nances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is changed and amended in order to place the following described property in the City, to-wit: A part of the NWl/4 of the NWl/4 of Section 21 , Township 7 North, R nge 69 West of the Sixth P.M. , which considering the North line of said NW�/4 as bearing S. 89°41 ' E. and with all bearings contained herein relative thereto, is contained with the boundary lines which begin at a point on said North line which bears S. 89041 ' E. 1028.95 feet from the Northwest corner of said Section 21 , and run thence S. 89041 ' E. 262.05 feet; thence S. 00"46' E. 1376.94 feet; thence S. 89042' W. 1295.25 feet; thence North 00035' W. 28O.0O feet; thence N. 89042` E. 1032.34 feet; thence N. 00°46` -W. 1099.83 feet to the point of beginning; being in the City of Fort Collins, County of Larimer and State of Colorado; ALSO The SW1/4 of the NWl/4 of Section 21 , Township 7 North, Range 69 West of the 6th P.M. , containing 40 acres, more or less; being in the City of Fort Collins, County of Larimer and State of Colorado into the R-L-M, Low Density Multiple Family District .created by this Ordinance. Section 6. The City Engineer is hereby authorized and directed to amend the Zoning District Map of the City of Fort Collins in accordance with this Ordinance.
