BEING AN ORDI1dANCE VACATING AN ALLEY IN THE MILLER BROTHERS FOOTHILLS
SUBDIVISION, FIRST .FILING, SECOND FILING AND THIRD FILING, CITY OF FORT
COLLINS, COLORADO
WHEREAS, the City of Fort Collins has been petitioned to vacate an alley in
the Miller Brothers ' Foothills Subdivision, First Filing, Second Filing and Third
Filing, in the City of Fo,t Collins; and
WHEREAS, said alley as now platted is not needed for municipal purposes ex-
ceRt for the installation and maintenance of utilities nor will it be needed ita
the future for municipal purposes other than for utilities; and
WHEREAS, it appears that the rights of the residents of the City of Fort
Collins will in no way be prejudiced by the vacation of said alley; and
WHEREAS, the alley to be vacated constitutes a part of the exterior bound-
ary of the Miller Brothers ' Foothills Subdivision, First Filing, Second Filing and
Third Filing, and was at the time the same was dedicated a part of said Subdivisions .
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1 . That that certain alley more particularly described as follows ,
to-wit:
The alley between Elizabeth Street and Clearview Avenue adjoining on the
East of Lots 7, 8, 9 and 10 of the Miller Brothers Foothills Subdivision,
First Filing; and lots 39, 40 and 41 of the Miller Brothers ' Foothills
Subdivision, Second Filing; and Lots 79, 80 and 81 of the Miller Brothers '
Foothills Subdivision, Third Filing;
be and 'the same hereby is abolished, vacated and abated, subject to the reservation
contained in Section 2 hereof.
Section 2. There is hereby reserved unto the City of Fort Collins an easement
over, under and across said alley for the installation and maintenance and repair
of such utilities as may now be installed in said alley or as the City of Fort
Collins may desire to install in said alley in the future.
Section 3. Pursuant to the provisions of C.R.S. , 1963; 120-14-2, as amended,
title to the lands included within the alley hereby vacated shall vest in. the lots
within the Miller Brothers ' Foothills Subdivision, First Filing; Second Filing
and Third Filing, abutting said vacated alley.
Introduced, considered favorably on first reading and ordered published this
12th day of March, A.D. 1970, and to be presented for final passage on the 2nd day
of Apri-.L_A...D... 1970.
