HomeMy WebLinkAbout031 - 08/06/1970 - AMENDING CHAPTER 19 OF THE CITY CODE CREATING A NEW ZONE TO BE KNOWN AS THE H-B, HIGHWAY BUSINESS DI CsA ^cLd J/6/ 7a ORDINANCE NO. 31 , 1970, BEING AN ORDINANCE AMENDING CHAPTER 19 OF THE CODE OF ORDINANCES OF THE CITY OF FORT COLLINS, COLORADO, 1958, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE AND CREATING A NEW ZONE TO BE KNOWN AS THE H-B; HIGHWAY BUSINESS DISTRICT, AND DELETING CERTAIN PERMITTED USES FROM THE B-L, LIMITED BUSINESS DISTRICT AND THE GENERAL BUSINESS DISTRICT, THE R-H,HIGH DENSITY RESIDENTIAL DISTRICT, THE C. COMMERCIAL DISTRICT, AND THE B-P, PLANNED BUS NESS DISTRICT: BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1 . That Chapter 19 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended by adding a new section after Section 19-36 of said Chapter to read as follows: "Section 19-36A. H-B, Highway Business District (automobile oriented business) . 1 . Uses,permitted. 1 Any use permitted in the R-M, Medium Density Residential District, provided any such use complies with all of the use requirements of such district, except that the minimum area of lot provision of this District shall be applicable. (2) Public utility installations excluding repair and storage facilities. (3) Any use permitted in the B-L, Limited Business Zone--not located in a shopping center--subject to the. following requirements: (a) The yard and parking requirements of the B-L, Limited Business District shall be applicable. (b) The sign provisions of this District shall be applicable. (c) A plot plan showing proposed landscaping and screening shall be presented to the Planning and Zoning Board and approved by the Planning and Zoning Board. In the event the Planning and Zoning Board fails to approve such plan, the matter may be appealed to the City Council . (4) Any use permitted in the B-G, General Business District, except public utility installations. (5) Automobile and mobile home sales. (6) Drive-in or drive-through facilities as a principal use (restaurants, theaters , car-washs, banks, etc.) . (7) Gas stations. (8) Motel and motor hotels. (9) Shopping centers. (10) Other business uses which have environmental influences similar to uses (4) through (9) inclusive. (11 ) Accessory buildings and uses. PROVIDED, uses (4) through (10) inclusive are a part of a unit development plan as defined, processed, and approved according to Section 19-44 of this Ordinance. FURTHER- PROVIDED, any use permitted in this District shall be separated from abutting residential Zoning districts by a fence or hedge of at least 6 feet in height which effectively screens the view on a year round basis, and all uses shall provide adequate fencing to control blowing debris. 2. Minimum area of lot. One-half of the total floor area of the building. 3. Minimum width of lot. Seventy-five eet. 4. Minimum yard. Fifteen feet from streets and alleys. 5. Minimum off-street parking. 1 For motels, motor hotels and tourist homes, one space for each guest room. ' (2) For shopping centers, 2.2 square feet of parking area for each one square foot of gross leasable area within which a minimum of 5.5 spaces per 1 ,000 square feet of gross leasable area must be developed. c/ (3) For business uses not otherwise specified, one space for every 200 square feet of floor area. - 6. Minimum service line requirements. 1 For each drive-in or drive-through service bay, three spaces on the entrance side and one space on the exit side. (2) Where the bay can be entered from either direction, the entrance requirements shall control for each direction. (3) In any case, parking, auto storage or service lines shall not be permitted in the street right-of-way." Section 2. That Section 19-36 of the Code of Ordinances of the City of Fort Collins., Colorado, 1958, as amended, be and the same hereby is amended by deleting from Subsection 1 thereof the following uses permitted: "Gas stations, hotels and motels." Section 3. That Section 19-36 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended by deleting from the title of said Section the following words: "(areas for controlled business and tourist uses)" and by substituting therefore the following words: "(neighborhood convenience centers)" . Section 4. That Section 19-37 of the Code of Ordinances of the City of Fort Collins , Colorado, 1958, as amended,be and the same hereby is amended by deleting from Subsection J thereof the following uses permitted: "Automobile sales, gas stations, tourist Homes" and by adding to the uses permitted the following: "Indoor theaters" . Section 5. That Section 19-37 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended by deleting from the title of said Section the following words: "(major business centers)" and by substituting therefore the following: "(downtown business district)" . . Section 6. That Section 19-32 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended,be and the same hereby is amended by adding to Subsection 1 thereof the following as a use permitted: "Tourist homes" . Section 7. That Section 19-38 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended,be and the same hereby is amended by adding to Subsection 1 thereof as a use permitted the following: "Mobile home sales" . Section 8. That Section 19-35 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended by adding to Subsection 1 (2) at the end thereof the following: "Shopping centers consisting of the above or similar uses" . Section 9. That Section 19-49 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended by adding a Subsection thereto following Subsection 14 thereof as follows: "14A. Gross Leasable Area. Gross leasable area is the total floor area designed for tenant occupancy and exclusive use, including basements , mezzanines and upper floors, if any, expressed in square feet measured from center.. lines of joint partitions and exteriors of outside walls. This does not include office buildings in which medical , dental , research and other kinds of special organizations are housed, nor theaters, which are a part of a shopping center." , and by adding to said Section a Subsection following Subsection 25 thereof as follows: "25A. Shopping Centers. A group of retail and service establishments located in a complex which is planned, developed, owned, or managed as a unit, with off-street parking provided on the property." -2- Section 10. That Section 19-42.4 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended by adding an additional Subsection thereto following Subsection (4). thereof as follows: "(4A) Signs in the H-B District shall be subject to the following restrictions . (a) No-free standing or rooftop signs shall be permitted except as may be provided in an approved unit development plan or under the provisions for construction signs contained herein. (b) High voltage discharge lighting methods may only be utilized for indirect illumination of signs; in no event shall flashing or otherwise animated signs be permitted. (c) Building signs (wall or fin provided the maximum total surface area for any one face of a sign does not exceed 200 square feet, and further provided that the maximum total surface area of such signs does not exceed one square foot for each lineal foot of lot frontage. In the event a permitted use has frontage on more than one dedicated street, each frontage shall be considered independently. (d) Construction signs for other than R-M uses shall be limited to one identification sign per building during period of construction (prior to occupancy of the building) provided such sign is unlighted and does not exceed 100 square feet in area per face. (e) No sign shall be permitted in, or to extend over, required yards or public right of way. Section 11 . That Section 19-47 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended by adding thereto an additional Subsection as follows: "10. Signs to conform within three years. All signs not in conformance with the sign provisions of this ordinance shall be brought into conformance with the requirements of this Ordinance within three years from the effective date of this Ordinance. Any non-conforming sign which has been damaged by fire or other causes in excess of 50% of its original cost shall not be restored except in conformance with the provisions of this ordinance as appropriate to the particular zone in which such sign is located. Section 12. That Section 19-27 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, be and the same hereby is amended by changing Subsection 1 thereof to read as follows: "1 . Establishment of the Zoning Districts. In order to carry out the purposes of this ordinance, the City of Fort Collins, Colorado�is hereby divided into the following zoning districts : (1 ) R-E, Estate Residential District. (2) R-L, Low Density Residential District. (3) R-L-M, Low Density Multiple Family District. (4) R-M. Medium Density Residential District. (5) R-H, High Density Residential District. (6) R-P, Planned Residential District. (7) R-M-P, Medium Density Planned Residential District. (8) M-L, Low Density Mobile Home District. (9) M-M, Medium Density Mobile Home District. (10) B-P, Planned Business District. (11 ) B-L, Limited Business District. (12) H-B, Highway Business District. (13) B-G, General Business District. (14) C, Commercial District. (15) I-L, Limited Industrial District. (16) I-G, General Industrial District.
