BEING AN ORDINANCE VACATING`A; PORTION OF PONDEROSA DRIVE BETWEEN ORCHARD PLACE
AND MULBERRY STREET IN THE CITY OF FORT COLLINS.
WHEREAS, the City of Fort Collins has been petitioned to vacate a portion of Ponderosa
Drive between West Mulberry Street and Orchard Place in the City of Fort Collins; and
WHEREAS, said portion of said street is not needed for municipal purposes, nor will
it be needed in the future for municipal purposes; and
WHEREAS, it appears that the rights of the residents of the City of Fort Collins will
in no way be prejudiced by the vacation of said portion of said street; and
WHEREAS, all of Ponderosa Drive between West Mulberry Street and Orchard Place at the
time the same was dedicated for public use constituted the exterior boundary of the tract
of land lying to the West thereof.
NOW, THEREFORE, BE IT ORDAINED BY THE- COUNCIL OF THE CITY OF FORT COLLINS:
Section 1 . That that portion of Ponderosa Drive between West Mulberry Street and
Orchard Place in the City of Fort Collins described as follows:
Beginning at the NE corner of the Green Meadow Homesites
Subdivision, First Filing, in the City of Fort Collins,
Colorado, thence S. 0025' E. along the East line of said
Subdivision 40 feet to the true point of beginning, thence
continuing S. 0*25' E. 1 ,280 feet, thence N. 89°35'30" W.
2.00 feet, thence N. 0'25' W. 1 ,280 feet, thence S. 89*35'
30" E. 2.00 feet to the point of beginning.
be and the same hereby is abolished, vacated and abated.
Section 2. Pursuant to the provisions of C.R.S. 1963, 120-14-2(B) as amended, title
to the said vacated portion of Ponderosa Driver shall vest in the lots and lands abutting
Ponderosa Drive on the West thereof.
Introduced, considered favorably on first reading, and ordered published this 15th
day of October, A.D. 1970, and to be presented for fi 1 passage on the Alth day of November,
A.D. 1970.
