HomeMy WebLinkAbout069 - 11/19/1970 - RELATING TO THE LOCATION, USE AND OCCUPANCY OF MOBILE HOMES AND MOBILE OFFICES ORDINANCE NO._4�9:11970 BEING AN ORDINANCE RELATING TO THE LOCATION, USE AND OCCUPANCY OF MOBILE HOMES AND MOBILE OFFICES WITH THE CITY OF FORT COLLINS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: % Section 1 . Definitions. As used in this ordinance: a. Mobile home means a transportable single-family dwelling unit with per- manently attached under carriage originally consisting of springs, axles, wheels and hubs and suitable for year-round occupancy and containing the same type water supply, waste disposal and electrical conveniences as immobile housing. b. Mobile office means a unit similar to a mobile home but used or designed to. be used as office space. Section 2. When permitted: Mobile homes or mobile offices shall not be placed or occupied within the city except as allowed in this ordinance. Section 3. Use in mobile home zones. Notwithstanding that a mobile home may not in all respects comply with the building codes of the City of Fort Collins, a mobile home may be placed and occupied in the City of Fort Collins in any zone under the zoning ordinance of the city which specifically permits as a use mobile home occupancy. Section 4. Use in areas not zoned for mobile homes. Mobile homes and mobile offices may also be place and/or occupied in areas not zoned for mobile home occupancy under the following conditions: a. Storage. A mobile home may be stored (not occupied) on any property provided such storage is not contrary to any other law of the city. b. Display and sale. A dealer in mobile homes and mobile offices may dis- play the same a sales yard properly zoned for such use. No such mobile home or mobile office shall be occupied nor shall the same be used for purposes other than display unless such occupation or use is permitted under another provision of this ordinance. c. Construction buildings. A mobile home or mobile office may be used as a temporary building in conjunction with construction work in any area of the city provided that a special permit from the building inspector is obtained pursuant to the applicable provisions of the City of Fort Collins Building Code. d. Temporary Office space. A mobile home or mobile office may be occupied as temporary office space in fire zones 2 and 3 of the city in the IG, General Industrial , IL, Limited Industrial , C. Commercial , BG, General Business and HB, Highway Business zoning districts under a special use permit to be issued by the building inspector. Such permit shall be issued for a period of one year and shall be renewable for one additional year only. Any such permit issued shall provide that upon the expiration of the permit period, the owner shall remove the mobile office or mobile home and properly protect any utilities used in connection therewith. No such permit shall be granted by the building inspector unless the applicant conforms to the requirements set forth in Section 5 hereunder, which requirements are deemed necessary for the protection of the public health, safety and welfare. Section 5. Requirements for temporary office space. Before granting a permit for the temporary occupancy of a mobile office pursuant to Section 4 (d) above, the applicant shall meet the following criteria: a. The gross area of such mobile office shall not exceed 1000 square feet as calculated from exterior dimensions in fire zone 2 and 1500 square feet as calculated from exterior dimensions in fire zone 3 of the city. b. The mobile office shall not exceed twelve feet and ane story in. height. c. A minimum clear space of thirty feet shall be maintained on all four sides of the mobile office in fire zone 2 and a minimum clear space of twenty feet shall be maintained on all four sides of a mobile office on fire zone 3. The method of measuring location on property shall be that provided in Chapter 5 of the City Building 'Code. d. Sewer, water and electrical connections to the mobile office shall be provided and the permanent installation of these utilities on the premises shall comply in all respects with the pertinent codes and ordinances of the city. Such compliance shall be demonstrated on drawings accompanying the application for the permit. e. Adequate permanent anchorages designed to stabilize' the mobile office against a wind load of 25 pounds per square foot acting in any direction shall be provided. The overturning moment calculated from the wind pres- sure shall not exceed two thirds of the dead load resisting moment. f. Each mobile unit shall have not less than two exits separated by one-fifth the perimeter of the unit.measured in a direct line between exits. g. A five pound ABC fire extinguisher shall be mounted adjacent to each exit. h. Sanitary facilities as required for- F-2 occupancies in Chapter 11 of the City's Building Code shall be provided for each mobile office. If both sexes are employed in the mobile office, at least two toilets and labora- tories shall be provided. in the mobile office. i . Plumbing, electrical , heating and ventilation systems including air con- ditioning installed in the mobile office shall be inspected for com- pliance with generally accepted welfare and safety standards. Potential cross connections and all unsafe or unsanitary conditions shall. be cor- rected prior to connection to any utility. j. No final permit for occupancy of a mobile office shall be granted until the building inspector or his designated representative has inspected the mobile office on the site and found that the unit complies with the requirements herein. k. The Chief of the Fire Department shall cause all mobile office installations for which a permit has been granted hereunder to be inspected once each calendar quarter and shall have the authority and duty to summarily suspend the permit to occupy any mobile office which fails to comply fully with the standards enumerated herein. Failure to correct any deficiency within five d days after receipt of written notice shall automatically void the permit granted under this ordinance. 1 . Any permit granted pursuant to this ordinance shall expire by limitation and become null and void if the mobile office is not emplaced and approved for occupancy within seventy-five days of the date on which the permit is granted. Section 6. Safety clause. If any provision of this Ordinance is declared invalid by any Court of competent jurisdiction, it is hereby declared to be the legislative intent that the effect of such decision shall be limited to that provision or provisions which are expressly so stated to be invalid and such decision shall not affect, impair or nullify any other provision of this Ordinance.
