ORDINANCE NO .2`I 1972
BEING AN ORDINANCE REPEALING ORDINANCE NO 19 1968
WHEREAS heretofore on May 23 1968 the City Council passed Ordinance
No 19 1968 on second reading and
WHEREAS thereafter on June 13 1968 there was submitted to the
City Council a petition for a referendum on said Ordinance which petition was
rejected by the City Council for the reasons given in a Resolution duly passed
by the City Council on July 3 1968 and
WHEREAS having rejected said referendum petition the City of Fort
Collins applied to the Court for a determination of whether or not the referen
dum should have been allowed and the Supreme Court of the State of Colorado
has now rendered an opinion that the referendum does apply to rezoning Ordinances
and
WHEREAS the City Council has in accordance with Section 3 of Article
XVII of the Charter of the City of Fort Collins reconsidered said Ordinance and
has determined the same shall be repealed
NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Ordinance No 19 1968 be and the same hereby is repealed and
the property which was the subject of said Ordinance shall by virtue of such
repeal revert to the zoning district in which it was placed prior to the adoption
of said Ordinance namely the R L Low Density Residential Zoning District
Introduced considered favorably on first reading and ordered pub
lashed this 25th day of May A D 1972 and to be presented for final passage
on the 15th day of June A D 1972
