HomeMy WebLinkAbout040 - 07/20/1972 - ANNEXING THE LINDEN STREET TECH CENTER ANNEXATION - r- ORDINANCE NO 40 , 1972 BEING AN ORDINANCE ANNUING CIRTAIN TERRITORY TO TiIE CITY OF FORT COLLINS, COLORADO WHEREAS heretofore a kritten petition together with four prints of an annexation map was filed with the City Clerk of the Cit> of Fort Collins requesting the annexation of certain territory more particularly described below to the City of Fort Collins, Colorado, and WHEREAS, the City Council has found and determined and does hereby find and determine that said petition is in substantial compliance with the provisions of Colorado Revised Statutes, 1963, 9 137-21-6, as amended, and WHEREAS the owners of one hundred per cent of the property to be annexed have petitioned for said annexation, and WHEREAS, not less than one-sixth of the perimeter of the area to be annexed is con- tiguous with the City of Fort Collins and a community of interest exists betheen the territory to be annexed and the City of Fort Collins and the territory to be annexed is urban or will be urbanized in the near future and sucn territory is integrated or is capable of being integrated with the City of Fort Collins, and WHEREAS, none of the provisions of Colorado Revised Statutes, 1963, § 139-21-4, as amended, are violated by the annexation of this territory to the City of Fort Collins, and WHEREAS, no election is required under the provision of Colorado Revised Statutes, 1963, § 139-21-6 (2) , and no additional terms and conditions are to be imposed in connection with this annexation, ana WHEREAS, the territory is eligible for annexation and the City Council desires to annex the same to the City of Fort Collins NOW, THEREFORE, BE IT ORDAINED BY THE COMgCIL OF THE CITY OF FORT COLLI4S Section 1 That all of the territory more particularly described as situate in the County of Larimer, State of Colorado, to-wit A tract of land situate in the Northwest 1/4 of Section 12 , Town— ship 7 North, Range 69 I4est of the Sixth P M , Lariner Courzy, Coloraco, which, considering the East line of saia N7ortnwest 1/4 as bearingS,000 11 ' W and w�tn all bearings contained herein relative thereto, is contained witnin the boundary lines whxc`� begin at a point, on the Southerly right—of—way line of the Colo— rado and Southern Railroad, which bearsS 000 11 ' 11 156 86 feet and againS_ 880 30 ' W 461 52 feet from the North 11A corner of said Section 12 and run thence, along the Westerly right—of—wav line of Linden Street, S 000 49 ' W 533 12 feet and again along the arc of a 448 34 foot radius curve to the right a distance of 315 92 feet, the long chord of which bearsS 210 00 ' W 309 42 feet and again 8410 11 ' W 439 04 feet, thence N 890 a9 ' W 453 13 feet, the^ce N 000 01 ' E 1052 70 feet to a point on the Southerly right-of-way of the Colorado and Southern Railroad, thence along the arc of a 930 37 foot radius curve to the right a distance of 377 75 feet, the lora charc of which bears N 760 52 ' 05" E 375 16 feet, tnence N 880 30 ' E 495 62 feet to the point of beginning, containing 20. 004 acres, more or less 1- be and it hereby is annexed to the City of Fort Collins and made a part of said City, to *be known as the Linden Street Tech Center Annexation to the Cit> of Fort Collins Section 2 That in annexing said territory to the City of Fort Collins, the City of Fort Collins does not assume any obligations respect_ng the construction of water mains, sewer lines, gas mains, electric service lines, streets or any otner services or utilities in connection with the territory hereby annexed except as may be provided by the ordinances of the City of Fort Collins Introduced, considered favorably on first reading, and ordered published this 29th day of June, A D 1972 , and to be presented for final passage on the 20th day of July, A D 1972 ril,oO7.14' Ma r ATTEST City Clerk Passed and adopted on final reading this 20th day of July, A D 1972 Mayor ATTEST City Cler `- r -2-
