APPROVING THE ACQUISITION OF CERTAIN WATER RIGHTS, DETERMINING
THAT THE AVAILABILITY OF SUCH WATER RIGHTS IS AN UNFORESEEN
CONTINGENCY ARISING AFTER THE PASSAGE OF THE ANNUAL APPROPRIA-
TION ORDINANCE AND APPROPRIATING THE SUM OF $91,250 00 FOR
THE PURPOSE OF PURCHASING SUCH WATER RIGHTS
WHEREAS, offers have been made to the City of Fort Collins to convey
to the City certain water rights consisting of 125 units of the Northern
Colorado Water Conservancy District and 50 shares of the North Poudre Irriga-
tion Company, and
WHEREAS, the availability of such water rights was not anticipated
at the time of the passage of the Annual Appropriation Ordinance for the City,
and such availability is therefore, for an unforeseen contingency within the
exception contained within Section 8 of Article V of the City of Fort Collins,
and
WHEREAS, in the opinion of the City Council, it is in the best interest
of the City to acqi1ire such water rights at the price asked by the owners of the
same, to-wit $250 00 per unit and $1,200 00 per share
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 That the City Council hereby finds and determine that the
availability of the water rights mentioned above is an unforeseen contingency d
arising after the passage of the Annual Appropriation Ordinance
Section 2 The acquisition of such water rights at a price of $91,250 00
is hereby authorized, and the Acting City Manager is directed to acquire such
water rights at such total price
Section 3 There is hereby appropriated from unbudgeted surplus
funds in the Water Fund for extensions, improvements, enlargement and better-
ment, the sum of $91,250 00 , such amount to be expended for the acquisition
of said additional water rights by the City
Introduced, considered favorably on first reading, and ordered pub-
lished this 29th day of June, A D 1972, and to be presented for final passage
on the 20th day of July, A D 1972
