L, 1972 BEING AN ORDINANCE DETERMINING THAT THE NEED FOR A PROGRAM TO COMBAT DUTCH ELM DISEASE IS AN UNFORESEEN CONTINGENCY ARISING AFTER THE PASSAGE OF THE ANNUAL APPROPRIATION ORDINANCE AND APPROPRIATING THE SUM OF $25,971.00 FOR SUCH PROGRAM WHEREAS, since the adoption of the budget and the passage of the Annual Appropriation Ordinance for the City, therehas been an increase in trees in the City infected with Dutch Elm Disease; and WHEREAS, in order to combat such disease, it is necessary to maintain an aggressive program of trimming and removing any dead limbs or infected trees; and WHEREAS, the Forestry Department has proposed a program to combat Dutch Elm Disease on City lands; and WHEREAS, the extent of the need for such program was not anticipated at the time of the passage of the Annual Appropriation Ordinance and such need is, therefore, an unforeseen contingency within the exception contained within Section 8 of Article V of the Charter of the City of Fort Collins. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the City Council hereby finds and determines that the need for an increased program to combat Dutch Elm Disease in connection with Elm trees on City property is an unforeseen contingency arising after the passage of the Annual Appropriation Ordinance. Section 2. There is hereby appropriated from unbudgeted surplus general funds to the Forestry Department Fund, the sum of $25,971.00 to be expended on the care of Elm trees on City property.
