BEING AN ORDINANCE ANNEXING CURTAIN TIiRR[TOItY TO T11E CITY or FORT COLLINS COLURADO
WHEREAS, heretofore a written petition, together with four prints of an annexation
map was filed with the City Clerk of the City of Fort Collins requesting the annexation
of certain territory more particularly described below to the City of Fort Collins,
Colorado; and
WHEREAS, the City Council has found and determined and does hereby find and determine
that said petition is in substantial compliance with the provisions of Colorado Revised
Statutes, 1963, § 137-21-6, as amended; and
WHEREAS, the owners of one hundred per cent of the property to be annexed have
petitioned for said annexation; and
WHEREAS, not less than one-sixth of the perimeter of the area to be annexed is con-
tiguous with the City of Fort Collins and a community of interest exists between the
territory to be annexed and the City of Fort Collins and the territory to be annexed is
urban or will be urbanized in the near future and such territory is integrated or is
capable of being integrated r:ith the City of Fort Collins; and
WHEREAS, none of the provisions of Colorado Revised Statutes, 1963, § 139-21-4, as
amended, are violated by the annexation of this territory to the City of Fort Collins; and
WHEREAS, no election is recuired under the provision of Colorado Revised Statutes,
1963, § 139-21-6 (2) , and no additional terms and conditions are to be imposed in connection
with this annexation; and
WHEREAS, the territory is eligible for annexation and the City Council desires to annex
the same to the City of Fort Collins.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1 . That all of the territory more particularly described as situate in the
County of Larimer, State of Colorado, to-wit:
A tract of land located in the SW 1/4 of Section 26, T7N, R69W, of the 6th
P.M. , Larimer County, Colorado, being more particularly described as follows:
Considering the South Line of the SW 1/4 of said Section 26 as bearing
S 890 42' 44" W and with all bearings contained herein relative thereto:
Commencing at the S 1/4 Corner of said Section 26, thence along the said
south line, S 890 42 ' 44" W, 366.30 feet to the True Point of Beginning.
Thence, continuing along said south line, S 89° 42 ' 44" W, 623.64 feet;
thence, N 000 21 ' 35" W, 1324.97 feet to a point on a line which is contiguous
to the city limits of the City of Fort Collins ; thence, along said line, said
line also being the north line of the SE 1/4 of the SW 1/4 of said Section 26,
N 89° 46' 20" E, 992.14 feet to the NE corner of the SE 1/4 of the SW 1/4 of
said Section 26; thence, along the north-south centerline of said Section 26,
S 000 15' 47" E, 663.93 feet; thence, leaving said section line, S 890 42' 44" W,
366.30 feet; thence, S 00° 15' 47" E, 660.00 feet to the True Point of Beginning.

be and it hereby is annexed to the City of Fort Collins and made a part of said City, to
be known as the Cunningham Corner Annexation to the City of Fort Collins
Section 2 That in annexing said territory to the City of Fort Collins, the City of
Fort Collins does not assume any obligations respecting the construction of t,ater mains,
sewer lines, gas mains, electric service lines, streets or any other services or utilities
in connection with the territory hereby annexed except as may be provided by the ordinances
of the City of Fort Collins
Introduced, considered favorably on first reading, and ordered published this 26th
day of October, A D 1972 , and to be presented for final passage, on the 16th day of
