Home My WebLink About101 - 06/07/1973 - ANNEXING THE GUARD THIRD ANNEXATION ORDINANCE NO. 101 19 72 BEING AN ORDINANCE ANNEXIXG CERTAIN TERRITORY TO TIIE CITY OF FORT COLLINS, COLORADO WHEREAS, heretofore a written petition, together with four prints of an annexation - map was filed with the City Clerk of the City of Fort Collins requesting the annexation of certain territory more particularly described below to the City of Fort Collins, Colorado; and WHEREAS, the City Council has found and determined and does hereby find and determine that said petition is in substantial compliance with the provisions of Colorado Revised Statutes, 1963, § 137-21-6, as amended; and WHEREAS, the owners of one hundred per cent of the property to be annexed have petitioned for said annexation; and WHEREAS, not less than one-sixth of the perimeter of the area to be annexed is con- tiguous with the City of Fort Collins and a community of interest exists between the territory to be annexed and the City of Fort Collins and the territory to be annexed is urban or will be urbanized in the near future and such territory is integrated or is capable of being integrated with the City of Fort Collins; and WHEREAS, none of the provisions of Colorado Revised Statutes, 1963, § 139-21-4, as amended are violated by annex ation of this territory to the City of Fort Collins; and the x WHEREAS, no election is required under the provision of Colorado Revised Statutes, 1963, § 139-21-6 (2) , and no additional terms and conditions are to be imposed in connection with this annexation; and WHEREAS, the territory is eligible for annexation and the City Council desires to annex the same to the City of Fort Collins . NOW, THEREFORE, BE IT ORDAINED BY TIIE COUiCIL OF THE CITY OF FORT COLLINS: Section 1 . That all of the territory more particularly described as situate in the County of Larimer, State of Colorado, to-wit: A tract of land situate in the 14est 11 of the Southeast 4 of Section 24, Township 7 North, Range 69 West of the Sixth P.M. , which considering the South line of the Southeast ', of said Section 24 as bearing N 89051130" E. and with all bearings contained herein relative thereto, is contained within the boundary lines which begin at the South 4 corner of said Section 24, and run thence along said South line of said Southeast %, N 89051'30" E. 1321.34 feet to the East line of the West ' of the Southeast ', of said Section 24; ` thence N 00001145" W. 1701.71 feet along said East line; thence along the arc of a 1554.97 foot radius curve to the left a distance of 209.23 feet, the long chord of which bears S 81°51117" W. 209.05 feet; thence S. 78000' W. 176.00 feet; thence along the arc of a 628.89 foot radius curve to the right a distance of 280.05 feet, the long chord of which bears N 89014135" W. 277.74 feet; thence continuing along the arc of said curve to the right a distance of 246.81 feet, the long chord of which bears N. 65014135" W. 245.23 feet; thence N. 54000' W. 140.00 feet; thence along the arc of a 308.30 foot radius curve to the left a distance of 193.40 feet; the long chord of which bears N. 71058115" W. 190.24 feet; thence N. 89056'30" W. 145.00 feet to a point on the West line of the Southeast ', of said Section 24; thence S 000 03130" W. 1.886.48 feet along said West line to the point of beginning, con- taining 52.2798 acres, more or less. 4 ' i • J be and it hereby is annexed to the City of Fort Collins and made a part of said City, to be known as the Guard Third Annexation to the City of Fort Collins. Section 2. That in annexing said territory to the City of Fort Collins, the city,of Fort Collins does not assume any obligations respecting the construction of water mains, sewer lines, gas mains, electric service lines, streets or any other services or utilities in connection with the territory hereby annexed except as may be provided by the ordinances of the City of Fort Collins .
