BEING AN ORDINANCE VACATING AN ALLEY 114 BLOCK 51 IN THE CITY OF FORT COLLINS
WHEREAS, the City of Fort Collins has been petitioned to vacate an alley in
Block 51 of the City, and
WHEREAS, said alley as now platted is not needed for municipal purposes
except for the installation and maintenance of utilities over a portion of the same,
hereinafter described, nor will it be needed in the future for municipal purposes
other than for said utilities, and
WHEREAS, it appears that the rights of the residents of the City of Fort
Collins will in no way be prejudiced by the vacation of said alley
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That that certain alley more particularly described as the East-
West alley in Block 51 in the City of Fort Collins, Colorado, according to the re-
corded plat thereof, be and the same hereby is abolished, vacated and abated, sub-
ject to the reservation contained in Section 2 hereof
Section 2 There is hereby reserved unto the City of Fort Collins an ease-
ment over, under and across the South 6 feet of said alley for the installation,
maintenance, repair and reconstruction of such utilities as may now be installed or
as the City may hereafter desire to install in said 6 foot strip
Introduced, considered favorably on first readinq, and ordered published
this 5th day of August, 1971 , and to be presented for final passage on the 26th
day of August, A D 1971
