BLFtG AN ORDINMCE VALATING A PORTION OF AN ALLEY IN BLOCK
3150 CAPITAL HILL AUL)ITIIk%i TO 11% CITY OF FORT COLLINS
WMRhAS, the owners of the above property adjoining the sane have
petitioned the city of Fort Lollins to vacate a portion of the alley in Block
315, Lapital Hill Addition to the Lity of Fort Lollins, Lolorado, said portion
being more particularly described below, and
KiLR AS, all of the balance of said alley has heretofore been
vacated and the portion for which request to vacate has been made is not needed
for municipal purposes except for the installation and maintenance of utilities
over a portion of the same hereinafter described nor will the same be needed in
the future for municipal purposes other than for said utilities, and
WHERI.AS, it appears that the rights of the residents of the City of
Fort Lollins will in no way be prejudiced by the vacation of said alley
NOW, THhREMRE, BL IT ORDAINED BY TIC COUNLIL OF THb CITY OF FORT
LOLLINb
Section 1 That the South 140 feet of the alley in Block 315,
Lapital Hill Addition to the Lity of Fort Collins be and the same hereby is
abolished, vacated and abated subject to the reservation contained in Section 2
ne reof
Section 2 There is hereby reserved unto the Lity of Fort Collins
an easement over��'across said alley for the installation, maintenance, repair
and reconstruction of such utilities as may now be installed or as the Lity may
hereafter desire to install within said alley
Introduced and considered favorably on first reading, and ordered published
this 16th day of December, A L , 1971, and to be presented for final passage on the
