OF THE COUNCIL OF THE CITY 6F FORT COLLINS
BEING AN ORDINANCE VACATING AN ALLEY IN
INDIAN HILLS SUBDIVISION, FIFTH FILING
WHEREAS, the City Council has been petitioned to vacate an alley in
Indian Hills Subdivision, Fifth Filing, as more particularly described
below, and
WHEREAS, said alley is not presently needed as an alley or roadway,
and
WHEREAS, it appears that the rights of the residents of the City of
Fort Collins will in no way be prejudiced or injured by the vacation of
said alley, provided that there is reserved an easement for access to
utilities as are now constructed at said alley
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that that certain alley in Indian Hills Subdivision, Fifth Filing,
more particularly described as follows, to wit
A ten foot alley adjacent to the west lot lines of Lots
86 through 90, Indian Hills Subdivision, Fifth Filing,
City of Fort Collins, County of Larimer, State of
Colorado,
be, and the same hereby is, abolished, vacated and abated, except that
there is reserved unto the City of Fort Collins, an easement for access to
utilities as are now constructed in said alley
Introduced, considered favorably on fir t reading and order d pub-
lished this 6th day of January 1981
