HomeMy WebLinkAbout135 - 11/16/1982 - APPROPRIATING ANTICIPATED PROCEEDS FROM THE SALE OF BONDS IN THE CAPITAL PROJECTS FUND FOR SPECIAL I r � ORDINANCE NO 135, 1982 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING ANTICIPATED PROCEEDS FROM THE SALE OF BONDS IN THE CAPITAL PROJECTS FUND FOR SPECIAL IMPROVEMENT DISTRICT #77 WHEREAS, pursuant to the Chapter 16 of the Code of the City of Fort Collins, the Council has authorized the formation of Special Improvement District z477, and WHEREAS, the formation of said District was made possible by the voluntary participation of the property owners in the District, speci- fically, Osprey Homes, Inc , and WHEREAS, the property owners in said District desire that construction of all necessary improvements commence at the earliest possible date due to the possibility of inclement weather which would unnecessarily delay construction, and WHEREAS, the City desires to cooperate with the property owners in said district, and WHEREAS, pursuant to Section 8 of Article V of the Charter of the City of Fort Collins, the Council must appropriate funds prior to the City entering into a contract, and WHEREAS, pursuant to Section 35 of Article V of the Charter of the City of Fort Collins, the contract for the construction of special improve- ments to be paid by assessments can be entered into prior to the receipt of proceeds from the sales of bonds to finance said improvement district, and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS 1 That Seven Hundred Eighty-Three Thousand Dollars ($783 ,000 00) be, and the same hereby are, appropriated from the proceeds to be received by the sale of bonds in the Capital Projects Fund for Special Improvement District 077 2 That the immediate adoption of this ordinance is necessary to preserve, protect and advance the general welfare of the residents of the City of Fort Collins, therefore, the Council hereby determines that an emergency exists requiring the immediate passage of this ordinance, and this ordinance is therefore, enacted pursuant to Section 6 of Article II of the Charter of the City of Fort Collins as an emergency ordinance and shall be effective upon its passage r Introduced, considered favorably by 5 members of the Council of the City of Fort Collins and finally passed—as an emergency ordinance and ordered published this 16thday of November, 1982 Mayor ATTEST City Clerk -2-
