HomeMy WebLinkAbout014 - 02/05/1980 - AMENDING SECTION 118-74A OF THE CITY CODE RELATING TO PERMITTED USES IN THE ''T'' - TRANSITION ZONIN OPDINANCE NO 14 , 1980 BEING AN ORDINANCE OF THE COUNCIL OF THE CITY OF FORT COLLINS Ah1ENDINC SECTION 118-74A OF THE CODE OF THE CITY OF FORT COLLINS BEING A PART OF THE ZONING OPDIiiM CE AND RELATING TO PERMITTED USES IN THE "T" - TRANSITION ZONING DISTRICT BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Section 118-74A of the Code of the City of Fort Collins be, and the same hereby is, amended to read as follows "A Uses Permitted 1 No use shall be permitted of properties in this district except such use as existed on the date the property was placed in tills zoning district nor shall any permanent structures be constructed on any land in this zoning district, except that, at the time of zoning or rezoning of the property into this zoning district, the Council may grant a variance permitting expansion of any existing use or installation or enlargemert of a permanent structure to be used in connection with the use of the property at the time of such zoning or rezoning upon the following conaitions ( a) The owner of the property, prior to the Council meeting at which the zoning or rezoning is to be heard, shall submit a site plan showing in reasonable detail the existing and proposed uses of such property, and 1 T 111 I l l ti` it 4+l- C i b t I ,n Orly (spun a tii ling tiaz the ,Lricu application of the zoning ordinance relating to nunconforaing uses would result in exceptional or undue hardship upon the owner of the property and that the variance uidy De granted without Substantial detilment to the puplrc good and without suLstantially impairing the intent and purposes of the nonconforrrrng use ordinance 2 After property has been placed in the "T" - Transition Zoning District, the Zoning Board of Appeals may grant a variance in accordance witn SecLlons 118-20 and 118-21 of the Zonina Ordinance permitting installation of a perma- nent structure to be used in connection with the use of the property at the time the property was placed in this zoning district " Introduced, considered favorably on first reading, and ordered pub- lished this 22nd day of January , A D 1980, and to be presented for final passage on the 5th day of / )Itlebruary A D 1980 vc� �i Ma or ZA E Ci y Clerk Passed and adopted on final reading this 5th gay of Februaiy > 1980 Zlet.P' -2-
