OF THE COUNCIL OF THE CITY'UF FORT COLLINS
AMENDING THE UNIFORM APPEAL PROCEDURE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That Section 3(A)-4 (Filing of Notice of Appeal ) of the
Code of the City of Fort Collins be, and the same hereby is, amended to
read as follows:
3(A)-4 Filing Notice of Appeal
An appeal shall be taken by filing a notice of appeal of a final
decision of a board, commission or authority to which this
chapter applies with the City Clerk within fourteen (14) days
after final action of said board, commission or authority. Such
appeal shall contain the grounds for filing the appeal and shall
be accompanied by any documents containing new evidence which the
party-in-interest intends to present at the appeal hearing.
The detailed minutes of the board, commission or authority
shall be submitted to the Council as a portion of the record on
appeal . The appellant shall be charged a fee of Seventy-Five
Dollars ($75) for the cost of the appeal .
Section 2. That Section 3(A)-5 (Contents of Record of Appeal ) of the
Code of the City of Fort Collins be, and the same hereby is, amended to
read as follows:
3(A)-5 Contents of Record of Appeal

Any appeal to the Council shall be an appeal on the record
and the record provided to Council shall include the following:
A. The detailed minutes of the proceedings before the
board, commission or authority from which the appeal
has been taken.
B. All exhibits received by the board, commission or
authority at said proceedings.
Section 3. That Section 3(A)-7 (Decision of Council ) of the Code of
the City of Fort Collins, be, and the same hereby is, amended to read as
follows:
3(A)-7 Decision of Council
The Council shall consider an appeal based upon the detailed
minutes of the board, commission or authority and any new
evidence submitted and after consideration shall sustain ,
reverse or modify the decision of or send the matter back
for further hearing and review by the board, commission or
authority from which the appeal has arisen.
Introduced, considered favorably on first reading, and ordered pub-
lished this 21st day of December , A.D. 1982, and to be presented for final
passage on the 4th day of January A.D. 1983.
