HomeMy WebLinkAbout017 - 03/04/1980 - AMENDING CERTAIN SECTIONS OF CHAPTER 106 OF THE CITY CODE AS IT RELATES TO PROPERTY TAX REBATES FOR ORDINANCE NO 17, 1980 OF THE COUNCIL OF THE CITY OF FORT COLLINS BEING AN ORDINANCE AMENDIP+G CERTAIN SECTIONS OF CHAPTER 106 OF THE CODE OF THE CITY OF FORT COLLINS AS IT RELATES TO PROPERTY TAX RLBATES FOR THE ELDEPLY AiJD HANDICAPPED WHEPEAS, several citizen commissions of the City of Fort Collins nave met to consider modifications to the property tax rebate program for low- incore elderly residents of the City of Fort Collins, and WHEREAS, these commissions have recommenced that this program be expanded to provide for property tax rebates to handicapped individuals, and WHEREAS, these commissions have also recommended an adjustment to the income criteria used to determine eligibility for participation in the program tOW. THEREFORE, BE IT ORDAINED BY ThE COUNCIL OF THE CITY OF FOPT COLLINS Section 1 That the first and second sentences of Section 106-1 of the Code oT the City of Fort Collins be, and the same hereby are, amended to read as follows "§106-1 Enactment, Purpose, Applicability There is hereby enacted a tax refund program to provide relief from property taxes for lore-income elderly residents and handicapped residents of the C _y It is - ,e purpose of +J _ t, < r(-'u. 1 p^oqr am to refuno to low incorie elcerly residents and handicapped residents of the city, as defined in this chapter, the city's portion of property taxes for the preceding year, vhich such persons have pain Section 2 Tnat Section 106-3 (A) of the Code of the City of Fort Collins be, and the same hereby is, amended to read as follctitis "§106-3 Qualifications In order to be entitled to a refund under this pro- graoo, the applicant for such refund mist meet all of the following applicable requirements (A) The applicant or his spouse, if they live to- gether , must be sixty-five (65) years of age or older by August 1 of the year in wnich the application is submitted or be a handicapped individual as defined in this chapter No more than one (1) application shall be submitted or acted upon in connection with any single property in the City " Section 3 That Section 106-3 (D) of the Cooe of the City of Fort Collins be, and the same hereby is, anerded to read as follows "§106-3 Qualifications (D) If the applicant was not a member of a household during the preceding year when the taxes were assessed, his income for such year irust have been no greater than Seven Thousand Three hundred Dollars ($7,300 00), or , if the applicant was a member of a household during the preceding year when such tares were assessed , the combined income of all members of the household must have been no greater than Ten Thousand Eight Hundred Dollars ($10,800 00) for such preceding year " Section 4 That Section 106-6 of the Code of the City of Fort Collins be, and the same hereby is, amended Ly the addition of a definition, HANDICAPPED INDIVIDUAL, to read as follows "HANDICA°FED INDIVIDUAL - Any person who has a physical impairment from a physiological or neurological condition, or a disability attributable to mental retardation, cerebral palsy, or epilepsy , which prevents the exercise of normal physical func- tion " Sectiui, 5 That Section LG6 o of the code of he - sty of Fort u ,1 ins be, and the same hereby is, amended by changing the definition of INCOME to read as follows "INCOME -- Total income, including, but not limited to, salaries, wages, tips, employee compensation, interest, dividends, business or farm income, rents, royalties, social security benefits, public and private pension payments, annuities , support money, cash public assistance and relief, veteran ' s benefits ( except service connected disability payments) , workmens ' compensation and unemployment compensation benefits " Introduced, considered favorably on first reading, and ordered pub- lisned this 19th day of February A D 1980, and to be presented for final passage on trre 4th day of March A D 1980 r1a ATT T CI y C erl.
