HomeMy WebLinkAbout020 - 02/19/1980 - ADOPTING CHAPTER 90 OF THE CITY CODE AND PROVIDING FOR REIMBURSEMENTS FOR IMPROVEMENTS (NOT CONSIDER OPDINANCE NO 20 1980 \ OF THE COUNCIL OF THE CITY OF FORT COLLINS ADOPTING CHAPTER 90 OF THE CODE OF THE CITY OF FORT COLLINS AND PROVIDING FOR REIPiBURSEMENTS FOR IMPROVEMENTS BE If ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1\ That Chapter 90 of the Code of the City of Fort Collins be, and the same hereby is, adopted as follows "Chapter 90 Reimbursement for Improvements §90-1 Reimbursement for Improvements When a\ person or improvement district causes any of the following specified improvements to be const\r\ucted and other undeveloped proper- ties in the vicinity are in a position to receive benefit from said specified improve- ments, the person or district may enter into an agreement with the City to the effect that at such time \as said properties develop and realize benefit\froin said improvements, the City fray collect \a charge as set forth below and , if so collected , shall reimburse the person or district making the improvement to the extent of the collection so made The right of reimbursement pursuant to this ,�ectiron shall not exceey a period or ten (10) years froin the execution of the agreement The specified improvements subject to this provision are (a) Streets (b) Strt& lightinq or side,ialks g90 Compuzacion of Reimb.,r�,Pmant Char ce Reimbursement charges snall be calculated on the basis of benefit received in proportion to the entire improvement according to the following standard (a) In the case of the improvement of any street, upon all of the lots abutting on Not Cor\cs L4gre-cl r Ind itl U10Fo Clrin the i t )otl�lje t ch lrt or tract of l It d i s to the rrontage of all lots and lands so improved (b) In the case of improvements consisting of construction of street lighting or sidewalks, in proportion as the frontage of each lot or tract of land is to the frontage of all lots or lands In the case of any of the specified improve- ments, the City Council shall have the author- ity to determine the reimbursement charge by any other method which is equitable and just The reimbursement agreement may provide that any amounts due may be increased by an equit- able amount in recognition of the effects of inflation Introduced, considered favorably on first readina and ordered pub- lished this day of 1980, and to be presented for final passage on the day of 1980 Mayor ATTEST City Clerk 1980 Passed and adopted on second reading this day of , Nayor ATTEST City Clerk -2- I
