HomeMy WebLinkAbout032 - 03/04/1980 - AMENDING CHAPTER 16 OF THE CITY CODE AND PROVIDING FOR REIMBURSEMENT FOR STORM SEWER IMPROVEMENTS -- J OPDINAHCE NO .32, 1980 OF THE COUNCIL OF fhE CITY OF FORT COLLIi,; X ENDIP�G CHA°TLP 16 OF THE CODE OF THE CITY OF FOPT COLLIP ' AND PROVIDI \G FOR PLIhBIIkSEi ENT FOR STOW SE4rEP Ii Pf '(AEhEiNT) BE IT ORDAINED EY THE COUNCIL OF THE CITY OF FOnT COLLIiIS Section 1 That Chapter 16 of the Code of the City of Fort Collins be, and the same hereby is, amended by the addition of a new Section 16-37 to read as follows "b16-37 Reimbursement for Storm Sever Improvements then an improvement district is created for the purpose of installing storm sewer improvements, the City may enter into an agreement with the district which provides that at such time as properties, which were not included witnin the district but reed to utilize such storm crainaoe facilities for develop- ment, receir,e final oevelopment approval from the City Council , the City may collect a charge based upon contributing acreage, and if so collectea, shall reimburse the aistrict to the extent of tie collection so made The amount collecteg shall be in proportion to the amount assesses a4ainst property within the district at the time the inprovements Wert constructed plus any ancunt na-'cled pu sudirt Lo the aq E-cment wi Lh the district to recognize the effects of inflation Any rronies received pursuant to this Section snall be distributed on the basis of original contributing acreage to the property owners of properties original- ly included within the district Sdid rrnnies shall Le utilized first to pay any remaining portion of the improvement district assessment with the remainder, if any, to be reinbursed directly to the oricinal proper- ty owner The rignt to reimburserrent pursuant to this Section shall net exceed a period of ten (10) years from the execution of the agreement The City Council may approve an extension to the agreement exceeding ten (10) years " Passage of Ordinance That the immediate adontion of the foregoinc neasures are necessary to preserve, protect, and advance the general welfare and safety of the residents of the City of Fort Collins Tnere- fore, the City Council hereby determines that an emergency does exist requiring the imrediate passaae of this Ordinance, and this Ordinance is, therefore, enacted pursuant to Section 6 of Article II of the Charter of the City of Fort Collins as an Frier rency Crainanr_e and shall become effective upon its passage Introduced, considereo fa%orably by 7 menbers of Lne City Council uoon reading, finally passed as an Frlergency Ordindrice and orcered pub- lished this 4th oay of March A D 1960 i ors ` ATTEST � L_ z L City Clerk -2-
