BEING AN ORDINANCE VACATING A
RIGHT OF WAY FOR A PUBLIC ROAD
WHEREAS, heretofore Deines Homes, Inc , dedicated a
right of way for the extension of Riverside Avenue south
from Prospect Road by a dedication deed recorded in Book
1431 at Page 356 of the Larimer County records, and
WHEREAS, Riverside Avenue extending south from Prospect
Road has been realigned and is not located entirely within
the previous dedication; and
WHEREAS, the owners of the property over which Riverside
Avenue now extends have dedicated the right of way for such
road to the City; and
WHEREAS, it is desirable to vacate the former dedication
which is not needed for municipal purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF FORT COLLINS that the dedication previously made to
the City by the instrument recorded in Book 1431 at Page 356
of the Larimer County records be, and the same hereby is,
vacated, abated and abolished.
Introduced, considered favorably on first reading, and
ordered published this 1st day of August , A D.
1978, and to be presented for final passage on the 15th day
of August , A.D 1978
