OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING A PORTION OF THE ZONING CODE OF
THE CITY OF FORT COLLINS AND AUTHORIZING
THE COUNCIL OF THE CITY OF FORT COLLINS TO
VARY CERTAIN PROVISIONS FOR PLANNED UNIT
DEVELOPMENTS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows
Section 1 That Section 118-83 of the Code of the City of
Fort Collins be, and it hereby is, amended by the addition thereto
of the following subsection-
"L. VARIANCE PROCEDURE The City Council, upon
recommendation of the Planning and Zoning
Board, is empowered to grant variances to
any of the provisions of this section under
the following circumstances-
(1) the applicant demonstrates to the
satisfaction of the City Council, and
the City Council so finds, the plan
as submitted is equal to or better
than such plan incorporating the
applicable provision in this section
for which a variance is sought, and,
(2) the variance may be granted without
substantial detriment to the public
good and without substantially impairing
the intent and purpose of this section
Nothing contained in this section shall limit
or otherwise alter the authority of the Zoning
Board of Appeals to grant variances as set
forth in §118-20 of this Code."
Introduced, considered favorably on first reading and ordered
published this 19th day of September A D 1978, and to be
presented for final passage on the 3rd day of October , A D 1978
