1978, RELATING TO AN ASSESSMENT DEFERMENT
PROGRAM FOR SINGLE FAMILY AND TWO-FAMILY
DWELLINGS LOCATED WITHIN THE DOWNTOWN
IMPROVEMENT DISTRICT NO 1 AND PROVIDING
THAT ANY ASSESSMENT DEFERRED UNDER SAID
DEFERMENT PROGRAM SHALL NOT REQUIRE A CONTRACT
WITH THE CITY OF FORT COLLINS REQUIRING THAT AN
AMOUNT EQUAL TO THE TOTAL ASSESSMENT DEFERRED
ON ACCOUNT OF THE PROPERTY BE MADE TO THE CITY
BEFORE SUCH PROPERTY IS USED FOR ANY PURPOSE OTHER
THAN A SINGLE FAMILY OR TWO-FAMILY RESIDENCE
WHEREAS, heretofore, the Council of the City of Fort Collins adopted,
by Ordinance, an assessment deferment program for single family and two-
family dwellings within the Downtown Improvement District No 1, and
WHEREAS, said Ordinance provided that any owner applying for a defer-
ment under said deferment program would be required to enter into a con-
tract with the City of Fort Collins requiring that an amount equal to the
total assessment deferred on account of the property be paid to the City
of Fort Collins before such property could be used for any purpose other
than the site of a single family or two-family residence, and
WHEREAS, the Council of the City of Fort Collins does hereby find and
determine that it would be more equitable not to require property owners to
enter into such a contract requiring said owners to pay back the total
assessment deferred but rather for such owners to begin paying the assess-
ment at the time of conversion of the property to a use other than a single
family or two-family use
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
COLLINS, that Section 3 B of Ordinance No 104, 1978, be deleted in its
entirety
