AND PROVIDING FOR THE GENERAL CITY ELECTION TO BE HELD IN THE CITY OF FORT COLLINS, COLORADO, ON TUESDAY, THE 3RD DAY OF APRIL, 1979 WHEREAS, Article XVI , Section 2, of the Charter of the City of Fort Collins provides for a General City Election to be held on the first Tuesday after the first Monday in April , 1955, and bi-annually thereafter, and WHEREAS, said Charter further provides that the Council shall provide by ordinance for the manner of holding said elections and such additional regulations in respect thereto as may be necessary to accomplish the intent of the Charter NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section l That the General City Election be, and the same hereby is, called as provided by law to be held in the several precincts of the City of Fort Collins, Colorado, on Tuesday, the 3rd day of April , 1979 At such election, three (3) members of the City Council , nominated from the City at large, shall be elected to hold office for four (4) years from the first Tuesday in April after the second Monday in April , 1979 At such election, the following citizen' s initiative shall be submitted to a vote of the qualified electors of the City "BEING AN ORDINANCE TO PROMOTE MODERATE GROWTH IN FORT COLLINS WHEREAS, it is the intent of the people of Fort Collins to (a) Urge the adoption of a land use plan which may help to reduce crime and environmental pollution of various kinds and may help to pi event the deteriora- tion of the ai,ali*y of life in F-- Collins, (b) Prevent excessive growth which will increase city operating and capital construction expenses with attendant tax increases, (c) Assist in the revitalization of the core area in Fort Collins, and (d) Preserve the existing agricultural base in the Fort Collins area, and LHEPEAS, an annual limit of building permits for no more than 750 dwelling units (which will result in a population of approximately 125,000, an increase of approx- imately 53,000 people by the year 2,000) is a reasonable growth rate, considering the limited availability of water, gas and other natural resources in the Fort Collins area NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FOPT COLLINS AND/OR THE QUALIFIED ELECTORS OF THE CITY OF FORT COLLINS, COLORADO Section 1 That henceforth , further residential building permits, including mobile homes, with exceptions as herein stated below, shall be limited in number in each of seven 12-rr)nth periods, commencing July 1 , 1979 and ending July 1 , 1926, to provide for a limit of building permits for no more than seven hundred fifty (750) dwelling units per year Section 2 That the goals and policies of the Larimer County ComprLhensive Plan, heretofore adopted, are commended and the Fort Collins City Council is directed to cooperate with the Larimer County Commissioners to limit the popula- tion growth rate within five (5) miles of the existing Fort Collins City limits to no greater than three percent (3%) per year Section 3 That the limitations herein imposed shall not apply to (a) Constriction of four (4) or fewer single family dwelling units or construction of a four-plex or lesser numbered dwelling units, either of which construction is to tale place on a single lot that was in existence as of January 1 , 1977 or on a lot on a plat which was approved by the City Council on or before January 1 , 1977, (b) Industrial or cor—ercial construction, (c) Housing for the elderly and for low- income persons approved by the City Council, -2- (d) Any building permits issued on or before April 3, 1979, and (e) Projects of Colorado State University to provide dwelling or rental units for students or faculty of that institution Section 4 The City of Fort Collins shall not annex land, which is residentially developed, in the seven-year period between July 1 , 1979 and July 1 , 1986 that will increase the land area of the City more than two percent (2%) per year Any annexations for the purpose of providing open space in the Fort Collins area or annexations of residentially undeveloped land are excluded from this limitation Section 5 Nothing in this Ordinance shall be con- strued to prevent compliance with the provisions of the Zoning Ordinance or other applicable ordinances, regulations or codes Section 6 The Fort Collins City Council is directed to adopt any further ordinances or regulations, within ninety (90) days from April 3 , 1979, to implement the provisions of this Ordinance, including a system for allo- cating building permits to builders on the basis of merit for all types of construction Within the time set for the adoption of an implementing ordinance, building permits for no more than two hundred fifty (250) dwelling units shall be issued Section 7 If a portion of this Ordinance shall be held to be illegal , the illegality thereof shall not affect any other provisions of this Ordinance, it being the express intent that the provisions herein set forth are independent from each other and would have been approved without that portion which may hereafter be found to be illegal or invalid " Section 2 Said election shall be held and conducted as nearly as may be practicable in the manner prescribed by the Municipal Election Code (Article 10, Title 31 , C R S 1973) Each person offering to vote in said election must be a qualified elector registered to vote in the City of Fort Collins Voting machines shall be used at the election Section 3 The City ClerL snali pubiisn sucn noti(,es of tiie election and of the candidates and issues to be voted upon as may be required by law Section 4 The Board of Elections shall provide for determination of the winner in event of tie vote, for canvass of returns of said
