BEING AN ORDINANCE VACATING A
PORTION OF BANYON DRIVE IN THE
CITY OF FORT COLLINS, COLORADO
WHEREAS, the City Council has been petitioned to vacate a portion
of Banyon Drive south of the Azalea Drive as platted in Westgate, Second
Filing, in the City of Fort Collins, Colorado, as more particularly des-
cribed below, and
WHEREAS, said street is not needed as a roadway or alley, and
WHEREAS, it appears that the rights of the residents of the City of
Fort Collins will, in no way, be prejudiced or injured by the vacation of
said street, provided that there are reserved unto the City of Fort Collins
appropriate easements for utilities and drainage
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that that portion of Banyon Drive located south of Azalea Drive as
platted in Westqate, Second Filing, of the City of Fort Collins, be, and
the same hereby is, abated, vacated and abolished except that there
is reserved unto the City of Fort Collins, Colorado, utility and drainage
easements described as follows, to-wit
�A thirty-five (35) foot wide drainage and utility
easement located from ten (10) feet east of the center
line of the right-of-way to be dedicated to twenty-five
(25) feet west of the aforementioned center line
And,
A six (6) foot wide utility easement along the north
and south boundaries of the aforementioned right-of-
way, all as indicated on the attached drawing
Introduced, considered favorably on first reading and ordered pub-
lished this 13th day of March, A D 1979, and to be presented for final
passage on the loth day of April , A D 1979
