HomeMy WebLinkAbout178 - 01/03/1984 - VACATING A UTILITY EASEMENT AND ACCEPTING A REDEDICATION OF A UTILITY EASEMENT IN SILVERPLUME PUD •J ORDINANCE NO. 178, 1983 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A UTILITY EASEMENT AND ACCEPTING A REDEDICATION OF A UTILITY EASEMENT IN SILVERPLUME PUD WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate a utility easement in Tract B of Silverplume P.U.D. , set forth in more particular below; and WHEREAS, because of a change in the building footprint, the developer was unable to install water mains in a utility easement as dedicated with the original recorded plat of Silverplume P.U.D. ; and WHEREAS, the developer has dedicated and recorded a replacement easement; and WHEREAS, the rights of the residents of the City of Fort will in no way be prejudiced or injured by said vacation and acceptance of rededica- tion. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That that certain utility easement located in Tract B of Silverplume P.U.D. , set out in more particular as follows, to wit: Considering the westerly right-of-way line of Silver- plume Drive as recorded on the filing plat for SILVER- PLUME, A PLANNED UNIT DEVELOPMENT, in Book 1987, Page 109 of the Larimer County Clerk and Recorder, as bearing N 22°30'00" E and with all bearings contained herein relative thereto; COMMENCING at the southeast corner of Tract B of said Silverplume P.U.D. , ; thence, along the said right-of-way line of Silverplume Drive, N 22030'00" E 109.00 feet to the Point of Beginning of the centerline of said easement; thence N 67°30'00" W 104.00 feet; thence N 22°30'00" W 62.00 feet; thence N 22030'00" E 117.00 feet; thence N 67°30'00" E 40.00 feet; thence S 67030'00" E 119.56 feet to a point on said westerly right-of-way of Silverplume Drive, said point being the Terminus Point of said easement. be, and the same hereby is, vacated, abated and abolished. Section 2. That that certain utility easement located in Tract B of Silverplume P.U.D. , set out in more particular as follows, to wit: Considering the westerly right-of-way line of Silver- plume Drive as recorded on the filing plat for SILVER- PLUME, A PLANNED UNIT DEVELOPMENT, in Book 1987, Page 109 of the Larimer County Clerk and Recorder, as bearing N 22°30'00" E, and with all bearings contained herein relative thereto; COMMENCING at the southeast corner of Tract B of said Silverplume P.U.D. ; thence, along the said right-of-way line of Silverplume Drive, N 22030'00" E 109.00 feet to the Point of Beginning of the centerline of said easement; thence N 67 30'00" W 120.00 feet; thence N 22030'00" W 72.00 feet; thence N 22030' 00" E 87 .30 feet; thence N 67°30' 00" E 72 .00 feet; thence S 67030'00" E 120.00 feet to a point on said westerly right-of-way of Silverplume Drive, said point being the Terminus Point of said easement. be, and the same hereby is, accepted as the rededicated utility easement in Tract B of Silverplume P.U.D.
