OF THE COUNCIL OF THE CITY OF FORT COLLINS ,
VACATING ALL EASEMENTS AND RIGHTS OF WAY
IN CUNNINGHAM CORNER PUD WITH THE EXCEPTIONS OF
TRACTS A AND B, THE NORTH 30 FEET OF WINDMILL DRIVE
AND THE RIGHTS OF WAY OF SHIELDS STREET AND HORSETOOTH ROAD
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate all easements and rights of way in Cunningham Corner PUD; and
WHEREAS, the new owners of Cunningham Corner PUD have replatted a
portion of the area and have invalidated the previous street layout;
and
WHEREAS, staff has found a number of areas where the rights of way and
easements should remain in place; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by the vacation recommended by staff.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that all easements and rights of way in Cunningham Corner PUD with
the exceptions of Tracts A and B, the north thirty (30) feet of Windmill
Drive and the rights of way of Shields Street and Horsetooth Road be, and
the same hereby are, vacated, abated and abolished.
Introduced, considered favorably on first reading, and ordered pub-
lished this 15th day of November, A.D. 1983, and to be presented for final
passage on the 6th day of December, . 983.
