OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF A UTILITY AND ACCESS EASEMENT
AND A PORTION OF AN ACCESS EASEMENT
IN THE REPLAT OF LOTS 2, 3, 4 AND PART OF LOT 5
AND RCD DRIVE, OF THE
RCD PLAZA SOUTH SUBDIVISION
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate a portion of a utility and access easement and a portion of an
access easement in the replat of Lots 2, 3, 4 and part of Lot 5 and RCD
Drive, of the RCD Plaza South Subdivision, set forth in more particular
below; and
WHEREAS, this portion of the easement is no longer needed due to a
subsequent dedication, namely that accepted by Council motion on November
1 , 1983; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by' said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that that certain portion of a utility and access easement and a
portion of an access easement in the replat of Lots 2, 3, 4 and part of Lot
5 and RCD Drive, of. the RCD Plaza South Subdivision, set out more parti-
cularly as follows, to wit:
The South 2.00 feet of the 10-foot-wide Utility Easement adjacent
to Colboard Drive, situate in Lot 1, Replat of Lots 2, 3, 4 and
part of Lot 5, and Colboard Drive of tie RCD Plaza South Sub-
division.
A part of an emergency access easement situate in Lot 1, Replat
of Lots 2, 3, 4 and part of Lot 5, and Colboard Drive of the RCD
Plaza South Subdivision, which begins at a point which bears N
00005'00" W 43.00 feet and again N 89055'45" W 35.00 feet from
the Southeast corner of said Lot 1 and run thence N 89'55'45" W
225 .00 feet; thence S 00005' E 1 .00 feet; thence S 89055'45" E
225 .00 feet; thence N 00'05 '00" W 1 .00 feet to the point of
beginning
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading, and ordered pub-
lished this 1st day of November, A. D. 1983, and to be presented for final
passage on the 15th day of November , A. D. 1983.
