OF THE COUNCIL OF THE CITY-UF FORT COLLINS
AMENDING CERTAIN SECTIONS OF CHAPTER 118
OF THE CODE OF THE CITY OF FORT COLLINS,
BEING A PART OF THE ZONING ORDINANCE INSOFAR
AS IT RELATES TO THE DEFINITIONS OF ,
DRIVE-IN AND FAST FOOD RESTAURANTS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That section 118-11 (Definitions) of the Code of the City
of Fort Collins be, and the same hereby is, amended to read as follows:
RESTAURANT, DRIVE-IN - Any establishment whose principal business
is the sale of foods , frozen desserts , or beverages to the
customer in a ready-to-consume state and whose design, method of
operation or any portion of whose business allows foods, frozen
desserts, or beverages to be served directly to the customer in a
motor vehicle either by a carhop or by other means which elimi-
nate the need for the customer to exit the .motor vehicle.
Section 2. That Section 118-11 (Definitions) of the Code of the City
of Fort Collins be, and the same hereby is, amended to read as follows:
RESTAURANT, FAST-FOOD - Any establishment whose principal busi-
ness is the sale of foods or beverages to the customer in a
ready-to-consume- state, and whose design or principal method of
operation includes both of the following characteristics:
A. Foods, frozen desserts, or beverages are usually
served in edible containers or in paper, plastic,
or other disposable containers.
B. The consumption of foods , frozen desserts , or
beverages is allowed, encouraged, or permitted
within the restaurant building , within a motor
vehicle parked upon the premises , or at other
facilities on the premises outside the restaurant
building or for carry out for consumption off the
premises.
Introduced, considered favorably on first reading, and ordered pub-
lished this 18th day of October, A.D. 1983 , and to be presented for
final passage on the 1st day of N mb r A.D. 1983.
