HomeMy WebLinkAbout140 - 12/02/2008 - ANNEXING THE EAGLE VIEW NATURAL AREA SECOND ANNEXATION ORDINANCE NO. 140, 2008 OF THE COUNCIL OF THE CITY OF FORT COLLINS ANNEXING PROPERTY KNOWN AS THE EAGLE VIEW NATURAL AREA SECOND ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO WHEREAS, in October 2002,the City of Fort Collins(the"City")acquired certain property known as the"Eagle View Natural Area" (the"Natural Area") which area contains approximately 86 acres and is located south of Kechter Road,west of Interstate Highway 25,east of Strauss Cabin Road and north of the Fossil Creek Reservoir; and WHEREAS, the City Council desires to annex the Natural Area into the City, and WHEREAS,the Natural Area is solely owned by the City and is eligible for annexation under Sections 31-12-104(1)(a) and 31-12-105, C.R.S; and WHEREAS, it is in the best interests of the City to annex said Natural Area to the City; and WHEREAS, in order to establish one-sixth contiguity of the Natural Area to the existing boundaries of the City, it is necessary to annex the same in a series of two annexations, which annexations may, pursuant to Section 31-12-104(1)(a) C.R.S., be completed simultaneously and considered together by the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby finds and determines as follows: a. That the property described on Exhibit "A," attached hereto and incorporated herein by this reference, is entirely owned by the City, is not solely a public street or right-of-way,and is eligible for annexation as set out in Sections 31- 12-104(1)(a) and 31-12-105. b. That, pursuant to Section 31-12-106(3), the City Council may by ordinance annex said property to the City without notice and hearing as provided in Sections 31-12-108 and 31-12-109, C.R.S. Section 2. That the property shown on Exhibit "A" is hereby annexed to the City and made a part of said City, to be known as the Eagle View Natural Area First Annexation. Section 3. That, in annexing said property to the City, the City does not assume any obligation respecting the construction of water mains,sewer lines, gas mains,electric service lines, streets or any other services or utilities in connection with the property hereby annexed except as may be provided by the ordinances of the City. Section 4. That the City hereby consents, pursuant to Section 37-45-136(3.6), C.R.S., to the inclusion of said property into the Municipal Subdistrict, Northern Colorado Water Conservancy District. ATTEST: City Clerk -2- EXHIBIT "A" A tract of land located in the southwest quarter of Section 10,Township 6 North, Range 68 West of the Sixth Principal Meridian,Larimer County,Colorado,the said tract is also Lot 1 Brown MRD S- 1-91,as recorded at Reception No. 91035864 records of the Clerk and Recorder of the said Latimer County, being more particularly described as follows; Considering the north line of the Northwest Quarter of the Southwest Quarter of the said Section 10 as bearing South 89 degrees 25 minutes 41 seconds East between a 2.5"Aluminum Cap monument PLS 14823 at the West Quarter corner of Section 10 and a 2.5" Aluminum Cap monument PLS 12374 at the Northeast comer of the said Northwest Quarter of the Southwest Quarter of Section 10, based upon GPS observation and the City of Fort Collins coordinate base, and with all bearings contained herein relative thereto; Commencing at the said West Quarter comer of Section 10; THENCE along the said north line of the Northwest Quarter of the Southwest Quarter of Section 10, South 89 degrees 25 minutes 41 seconds East for a distance of 118.61 feet to the northerly extension of the west line of the said Lot 1 Brown MRD S-1-91; THENCE along the said extended line,South 01 degrees 11 minutes 56 seconds East for a distance of 37.09 feet to the northwest corner of the said Lot 1 and to the TRUE POINT OF BEGINNING of this description; THENCE along the north line of the said Lot 1, South 89 degrees 09 minutes 34 seconds East for a distance of 1175.43 feet; THENCE continuing along the said north line of Lot 1, along a curve to the right having a radius of 115.00 feet a central angle of 31 degrees 50 minutes 09 seconds and an are length of 63.90 feet, being subtended by a chord of South 73 degrees 14 minutes 29 seconds East for a distance of 63.08 feet to the east line of the said Lot 1; THENCE along the said east line of Lot 1, non-tangent from the previous curve, South 00 degrees 37 minutes 27 seconds West for a distance of 618.24 feet to the south line of the said Lot 1; THENCE along the said south line, South 69 degrees 16 minutes 14 seconds West for a distance of 110.96 feet; THENCE continuing along the said south line, North 89 degrees 37 minutes 16 seconds West for a distance of 1110.87 feet to the said west line of Lot 1; THENCE along the said west line,North 01 degrees 11 minutes 56 seconds West for a distance of 685.71 feet to the point of beginning.
