THE FEES FOR CERTAIN LICENSES CONTAINED WITHIN CHAPTER 73 OF THE CODE OF THE CITY OF FORT COLLINS WHEREAS, inflation has increased the cost associated with the munici- palities' provision of municipal services, and WHEREAS, municipalities depend upon revenues obtained from the collec- tion of license fees to offset the costs associated with the provision of said services, and WHEREAS, that certain license fees as set out more particularly below should be increased in order to effectively offset the costs associated with the provision of said services NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows Section 1 That Chapter 73, Article II, Section 3 of the Code of the City of Fort Collins be, and the same hereby is, amended to read as follows §73-3 License Required Annual Fee No person shall conduct any business as a second hand dealer in the City of Fort Collins without a license therefor The fee for such license shall be Twenty-Five Dollars ($25) per year or for any part of a year The Director of Finance, if he shall be satisfied that the applicant is a fit person to engage in carry on such business, shall issue a license to the applicant upon payment of the fee herein specified Section 2 That Chapter 73, Article IV, of the Code of the City of Fort Collins be, and the same hereby is, amended to read as follows Article IV Seasonal Vendor §73-13 Hawkers License Fee The license fee for a hawkers or peddlers license shall be paid annually The fee for one year shall be Twenty-Five Dollars ($25) §73 14 Sale of Evergreen Trees and Boughs A License required It shall be unlawful for any person or persons, firm or corporation to engage in the business of selling pine, fir, spruce, cedar or other evergreen trees commonly called Christmas trees, or boughs therefrom, within the corporate limits of the City of Fort Collins without first obtaining a license therefor B Written authority of owner required for cutting It shall be unlawful for any person, firm or corporation to sell at any time or offer for sale in the City of Fort Collins any pine, fir, spruce, cedar or other evergreen trees, or boughs therefrom, cut or procured from or within the public domain of the State of Colorado or the United States or from any private land within the State of Colorado without written authority having been first obtained from said State of Colorado or the United States or from the owner of such private land to cut and remove such trees therefrom C Trees offered for sale to be tagged It shall be unlawful for any person or persons, firm or corporation to have in his or its possession for sale or to sell or offer for sale in the City of Fort Collins any such trees hereinabove described until the same shall have been officially tagged with a tag furnished or approved by either the United States Forestry Service or the Colorado State Board of Forestry, and showing the place from which said trees were taken and the name and address of the owner of the lands from which taken D Use of streets and sidewalks restricted The use of side- walks, streets and alleys in the City of Fort Collins for keeping stocks of pine, fir, spruce, cedar or other ever- green trees, or boughs therefrom, for sale is prohibited except for making deliveries to purchasers E Applications for licenses Any person or persons, firm or corporation desiring a license to sell and dispose of pine, fir, spruce, cedar or other evergreen trees cut or severed, or boughs therefrom, within the corporate limits of the City of Fort Collins, shall male application therefor under oath to the Director of Finance of said city, and in such appli- cation shall specifically state and set forth the source of title of the trees or boughs to be sold, whether the sane or any part thereof were cut or procured within any public domain of the State of Colorado or of the United States or from any private land, and shall be required in connection with such application for such sale to furnish the said Director evidence of ownership of such trees or boughs or authority to cut and procure the sane from the public domain or from privte lands -2- F Issuance of licenses fees, expiration The Director of Finance shall , if he is satisfied from such application and the showing made by the applicant that such applicant has a bona fide title to said trees and boughs and that the same were not obtained illegally and in violation of any laws of the State of Colorado or of the United States relative to the cutting down of pine, fir, spruce, cedar or other evergreen trees upon the public domain, or that he or it has authority to cut and procure the same from the public domain or from private land, grant to such applicant a license upon the payment of a license fee of Twenty-Five Dollars ($25) , which said license shall expire on December 31 of the current year in which issued §73-15 (RESERVED) §73-16 (RESERVED) §73-17 (RESERVED) §73-18 (RESERVED) Section 3 That Chapter 73, Article II, Section 30(A) of the Code of the City of Fort Collins be, and the same hereby is, amended to read as follows A The fee for an auctioneer' s license shall be Twenty-Five Dollars ($25) per year, payable in advance Section 4 That Chapter 73, Article VI, Section 38 of the Code of the City of Fort Collins be, and the same hereby is, amended to read as fol- lows §73-38 License Fees License applications shall be accompanied by the appropriate license fees, which shall be as follows A For all theaters, opera houses, moving picture shores, and other similar facilities where shows are to be produced for the public, the fee shall be in the amount of One Hundred Dollars ($100) per annum B For drive-in theaters, the fee shall be Seventy-Five Dollars ($75) per annum -3- C For all circuses, menageries, and carnivals, the fee shall be Seventy-Five Dollars ($75) for each day that such enter- tainment is presented in the City, provided that for carni- vals, if more than 40 attractions are presented, an addi- tional fee of Two Dollars and 50/100 ($2 50) per day for each attraction over 40 shall be paid D For public dance halls, the fee for the license shall be Seventy-Five Dollars ($75) per year E In case of any attraction for which an annual fee is pro- vided, the license shall be issued for the period January 1 through December 31 In case of an application for license after January 1 of any year, the license fee shall not be pro-rated and the full fee shall be charged for a partial year Section 5 That Chapter 73, Article VIII , Section 45 of the Code of the City of Fort Collins be, and the same hereby is, amended to read as follows §73-45 License Fees and Duration A All licenses issued or granted under the provisions of Section 73-42 of this article shall be paid for at the following rate 1 For each pinball machine, the sum of One Hundred Dollars ($100) per year 2 For each of the tables named above, the sum of Fifteen Dollars ($15) per year 3 For each bowling alley, the sum of Fifty Dollars ($50) per year 4 For each shooting gallery, the sum of Eighty Dollars ($80) per year 5 For all other machines, devices, or games described in this article and for which no specific license fee is fixed, the sum of Seventy Dollars (70) per year Section 6 That said amendments become effective January 1 , 1982 -4-
