OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO
AN AGREEMENT REGARDING THE OPERATION OF
A BATTING CAGE CONCESSION AT CITY PARK
WHEREAS, the City of Fort Collins provides City Park for the use and
enjoyment of its residents; and
WHEREAS, in connection with the operation of City Park, the City of
Fort Collins has allowed various concession facilities in City Park;
and
WHEREAS, the City has agreed to grant a concession for the operation
of a batting cage at City Park; and
WHEREAS, Article V, Section 34 of the Charter of the City of Fort
Collins provides that,,,-"No .contract for service shall be made by the City
for a longer period than two years, unless authorized by ordinance, . . .";
and
WHEREAS, the proposed contract for the operation of a batting cage
concession at City Park is for a three year period with a renewal provision
for an additional two years.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and he hereby is, authorized to enter
into a contract with a concessionaire for the purpose of operating a
batting cage concession at City Park for a period of three years and with a
renewal provision for a period of two years.
Introduced, considered favorably on first reading, and ordered pub-
lished this 3rd day of May, A.D. , 1983, and to be presented for final
passage on the 17th day of May, A.D.• 3.
