HomeMy WebLinkAbout045 - 04/15/1980 - AMENDING CHAPTER 118 OF THE CITY CODE RELATING TO AND REGULATING FAMILY CARE HOMES AND CHILD CARE CE ORDINANCE NO 45 1980 OF THE COUNCIL OF THE CT Y OF FORT COLLINS AMENDING CHAPTER 118 OF THE CODE OF THE CITY OF FORT COLLINS BEING THE ZONING ORDINANCE AND RELATING TO AND REGULATING FAMILY CARE HOMES AND CHILD CARE CENTERS IN ZONING DISTRICTS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows Section 1 That Section 118-11 of the Code of the City of Fort Collins be, and the same hereby is, amended by the addition thereto of the following definitions CHILD CARE CENTER - Child care center means a facility by whatever name known which is maintained for the whole or part of a day for the care of five or more children under the age of 16 years and not related to the owner, operator or manager thereof, whether such facility is operated with or without compensation for such care and with or without stated educational purposes The term includes, but is not limited to the facilities commonly known as a day care center, day nurseries, nursery school , preschools, play groups, day camps, summer camps, centers for mentally retarded children and those facilities which give 24-hour care for dependent and neglected children, but specifically excludes any Family Care Home as defined in this Chapter Also included are those facilities for children under the age of 6 years with stated educa- tional purposes operated in conjunction with the public, private or parochial college or a private or parochial school , except that the term shall not apply to a kindergarten maintained in connection with a public, private or parochial elementery school system of at least six grades Kindergarten means any facility providing an educational program for children only for the year preceding their entrance to the first grade, whether such facility is called a kindergarten, nursery school , preschool , or by any other name FAMILY CARE HOME - A facility for child care in a place or residence of a family or person for the purpose of providing family care and training for a child under the age of 16 years who is not related to the occupants of such home The two categories of Family Care Homes are as follows A FAMILY FOSTER HOME - A facility providing care and training for a child or children not related to the caretaker for regular 24-hour care provided that such child or children is received from any state- operated institution for child care or from any child placement agency as defined in 26-6-102 (2) C R S 1973, as amended B DAY CARE HOME - A facility providing care and training for a child or children not related to the caretakers for more than two full consecutive days on a regular weekly basis, but not including 24-hour care A full day shall be defined as seven or more hours Section 2 That Section 118-43 A (8) of the Code of the City of Fort Collins be, and the same hereby is, amended to read as follows §118-43 A (8) Child care centers, provided that no child care center shall be permitted to be located in this zoning district on property which is within 1,500 feet from any existing child care center within the City For the purpose of this provision, the distance between an existing child care center and property on which a child care center is proposed to be built, shall be measured in a straight line from the closest point on the boundary line of the property on which the existing child care center is located to the closest point on the boundary of the proper- ty on which the proposed child care center is to be located Section 3 That Section 118-44 A (19) of the Code of the City of Fort Collins be, and the same hereby is, amended to read as follows §118-44 A (19) Child care centers Section 4 That Section 118-81 (B) of the Code of the City of Fort Collins be, and the same hereby is, amended by the addition thereto of the following (13) Family Care Homes (a) Family Foster Homes Family Foster Homes shall be permitted provided that the maximum of foster children in any given home shall not exceed four (4) -2- (b) Day Care Homes With respect to Day Care Homes, the tollowing regulations shall apply (1) The maximum number of day care children permitted at any one time shall vary according to the number of caretaker's children not attending full-day school as follows Maximum number of Caretaker's children day care children not attending full permitted at any day school one time 6 0 5 1 4 2 3 3 2 4 1 5 0 6 During the summer vacation of the school year, the maximum number of children, including caretaker's child- ren under 16 years of age, permitted in the day care home shall not exceed six (6) (2) Day care also may be provided to no more than two additional children of school age either before or after school hours, and on days during the regular school year when school is not in session, such as conference days and holidays, but not including summer vacations The number of such school- aged children permitted to be cared for is as follows Additional school age day care child- Caretaker's school age ren permitted during children under age 12 non-school times 0 2 1 1 2 or more 0 -3- ` r Section 5 That Section 118-82 (E) of the Code of the City of Fort Collins be, and it hereby is, amended to read as follows (E) CHILD CARE CENTER REGULATIONS A minimum of Two Thousand Five Hundred (2,500) square feet of outdoor play area shall be provided for fifteen (15) children or fewer with Seventy-Five (75) additional square feet being required for each additional child Such play area within or abutting any residential district shall be en- closed by a decorative solid wood fence or masonry wall or chain link fence with vegetation screen- ing, densely planted The height of such fence shall be a minimum of four (4) feet and shall comply with Section 118-81F of this Chapter Where access to preschool nurseries is provided by other than local streets, an off-street vehicular bay or driveway shall be provided for the purpose of loading and unloading children There shall be an indoor floor space reserved for school purposes of forty (40) square feet per child Such indoor floor space must be approved by the Chief Building Inspector Section 6 This ordinance is not intended nor shall be construed as superseding or affecting in any manner any protective covenants existing or hereinafter created for the benefit of any properties within the City limits Introduced, considered favorably on first reading, and ordered pub- lished this lst day of April A D 1980, and to be presented for final passage on the 15th day of AP ril R A D 80 Mayo A ST LZ Clerk I Passed and adopted on final reading i 15th day of Aril , A D 1980 Mayor ATTEST Ci y Clerk -4-
