HomeMy WebLinkAbout059 - 06/03/1980 - AMENDING CHAPTER 114 OF THE CITY CODE INSOFAR AS IT RELATES TO HANDICAPPED PARKING ORDINANCE NO 59 , 1980 OF THE COUNCIL OF THE CIT1T07 FORT COLLINS BEING AN ORDINANCE AMENDING CHAPTER 114 OF THE CODE OF THE CITY OF FORT COLLINS INSOFAR AS IT RELATES TO HANDICAPPED PARKING NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That Section 114-5 of the Code of the City of Fort Collins be, and the same hereby is, amended by adding a definition (HANDICAPPED PERSON) thereto, to read as follows "Handicapped Person A person so severely handicapped that he is unable to move from place to place without the aid of a mechanical device or who has a physical impairment verified by the director of the Division of Rehabilitation or a physician licensed to practice medicine in this state that such impairment substan- tially limits his ability to move from place to place " Section 2 That Chapter 114 of the Code of the City of Fort Collins be, and the same hereby is, amended by the addition of a Section (114-63 5) thereto, to read as follows (G� 1) "§114-63 5 Parking Privilege for the Handicapped A A vehicle with distinguishing license plates or an identifying placard, as provided for in the Colo- rado Revised Statutes, indicating that the occupant of said vehicle is a handicapped person as defined in this Code, may be parked along public streets regardless of any time limitation imposed by official signs upon parking in such area, except that such privilege shall not apply to zones in which (1) Stopping, standing, or parking of all vehicles is prohibited at all times, (2) Only special vehicles may be parked, or (3) Parking is not allowed during specific periods of the day in order to accommodate heavy traffic B A handicapped person may park in a parking space identified by an official sign as being reserved for use by the handicapped whether on public property or private property available for public use A placard or license plate issued to a handicapped person shall be displayed on the vehicle while parked in such space C The owner of private property available for public use may install official signs identifying parking spaces reserved for such use by the handicapped Such installation shall be at the owner's expense and in compliance with the Manual for Uniform Traffic Control Devices Such installation shall be a waiver of any objection the owner may assert concerning enforcement of this Section D It is unlawful for any person other than a handi- capped person to park in a parking space on public or private property which is clearly identified by an official sign as being reserved for use by the handicapped unless such person is parking the vehicle for the benefit of a handicapped person " Introduced, considered favorably on first reading, and ordered pub- lished this 20th day of May A D 980, and to be pres t d for final passage on the 3rd day of D 1980 M or ATTEST pp llA�QVO 1&e,;��City Clerk Passed and adopted on final reading this 3rd day of June A D 1980 A TE sty Clerk -2-
