BEING AN ORDINANCE A=SSING THE COST
OF WORK DONE ON TREES AGAINST PROPERTIES
IN THE CITY OF FORT COLLINS IN ACCORDANCE WITH
CHAPTER 109 OF THE CODE OF THE CITY OF FORT COLLINS
WHEREAS, Chapter 109 of the Code of the City of Fort Collins assigns
responsibility for certain required maintenance and the removal of trees to
the property owner off the property upon which such trees are located or
which abut property on which such trees are located, and
WHEREAS, said Chapt\\109 provides that if the property owner fails to
perform such work, the City will cause the work to be performed, and if the
owner fails to pay the cos\of the same, the City will assess such cost
against the appropriate property, and
WHEREAS, pursuant to Sectio\109-21 of the Code of the City of Fort
Collins, the Director of Finance has made a report to the City Council as
to the cost of such work done by the%\City under said chapter which has not
been paid in full by the property owner,, and
WHEREAS, appropriate notices were `iled May 19, 1980 by the Director
of Finance to the property owners concerned, and
WHEREAS, the City Council has held a hearing on the date specified in
said notice and has found and does hereby find,hat the costs hereinafter
assessed are proper and should be assessed against the appropriate proper-
ties within the City, and
WHEREAS, at the hearing held on June 17, 1980, the City Council heard
and considered protests and objections made concerning \the proposed assess-
ments and made such adjustments as they deemed proper \
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 That pursuant to Section 109-21 of the Code\Ofthe City of
Fort Collins, the cost of performing work on trees pursuant to Chapter 109
of the Code of the City of Fort Collins, including an additional 17% to
cover interest, legal , advertising fees, and costs of collection, is hereby
assessed upon the property responsible for such work in accordance with the
provisions of Section 109-21 of the Code of the City of Fort Collins, as
follows

Section 2 Such assessments shall be certified by the Director of
Finance to the County Treasurer and shall be on a parity with the tax lien
for general state, county, city, town or school taxes Such assessments
shall become delinquent on the 1st day of September after the date of
assessments, and after the same becomes delinquent shall be advertised and
sold by the County Treasurer at the same time or times, in the same manner,
and under all the same conditions and penalties and with the same effect as
now prescribed by the general laws of the State of Colorado for the sale of
real estate and default of payments of general taxes
