COLLINS BEING AN ORDINANCE RELATING TO THE REGULATION AND CONTROL OF THE DESIGN, CONSTRUCTION, INSTALLATION, QUALITY OF MATERIALS, LOCATION, OPERATION AND MAINTENANCE OF HEATING, VENTILATING, COOLING, REFRIGERATION SYSTEMS, INCINERATORS, AND OTHER MISCELLANEOUS HEAT PRODUCING APPLIANCES IN THE CITY OF FORT COLLINS, ADOPTING BY REFERENCE HERETO THE UNIFORM MECHANICAL CODE, 1979 EDITION OF THE INTERNATIONAL ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIALS AND THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, REPEALING ALL ORDINANCES IN CONFLICT OR INCONSIS- TENT HEREWITH AND PROVIDING A PENALTY FOR VIOLATION OF THE PROVISIONS OF SAID MECHANICAL CODE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS AS FOLLOWS Section 1 Adoption of Uniform Mechanical Code Pursuant to the power and authority conferred on the City Council of the City of Fort Collins by Title 31, Article 16, Section 202, Colorado Revised Statutes, 1973, as amended, and Article II , Section 7 of the Charter of the City of Fort Collins, Colorado, there is hereby adopted as the Mechanical Code of the City of Fort Collins, by reference thereto, the Uniform Mechanical Code, 1979 Edition, including specifically Appen- dices A, B, and C thereof, published by the International Conference of Building Officials, 5360 South Workman Mill Road, Whittier, California, 90601, all to have the same force and effect as if though set forth herein in every particular The subject matter of said Code includes comprehen- sive provisions and standards regulating and controlling the design, construction, installation, quality of materials, location, operation, and maintenance of heating, ventilating, cooling, refrigeration systems , incinerators, and other miscellaneous heat-producing appliances for the purpose of protecting public health, safety, and general welfare Section 2 Amendments to Uniform Mechanical Code Said Code is hereby amended and changed in the following respects A Table No 3-A (21 ) is hereby amended to read as follows "21 For each gas piping permit $7 50" B Section 421 is amended by adding a definition for sealed combustion system appliances as follows "Sealed combustion appliances are appliances which are constructed and installed so that all air for combustion is derived from the outside atmosphere and flue gases are discharged to the outside atmosphere " C Section 504 is amended by adding a new paragraph at the end thereof to read as follows "Gas-fired appliances other than approved sealed combustion system appliances shall not be installed in any room used or designed to be used for sleep- ing purposes, bathrooms, clothes closets, or in any closet or other confined space opening into any bathroom or bedroom " D Section 606 is amended by adding a new paragraph (f) to read as follows "In all residential occupancies, all solid fuel- burning fireplaces shall be provided with an approved combustion air supply which is an integral component of the fireplace " E Exception to Section 710-H is amended to read as follows "For appliances on a single story building or on a single story portion of a building, a portable ladder may be used " F Section 903 is amended by adding a new Subsection (d) to read as follows "d Spark arrestors Chimneys serving solid fuel burning fireplaces, stoves and appliances shall terminate in a substantially constructed spark arrestor having a mesh approved for the use Spark arrestors shall be adequately supported and secured " G Appendix B is amended by deleting Section 2125 with existing Subsections to be renumbered appropriately -2- H Section 2204 is hereby amended by deleting therefrom the word "galvanized" I Section 2207 is hereby amended by deleting subparagraph 6 thereof with existing subparagraphs to be renumbered appropriately J Section 2210 (a) is amended by deleting therefrom the first paragraph thereof and substituting therefor the following "(a) General Gas piping shall comply with the provisions of this Section and Section 2211 All natural gas regulations and tables except Table 22 D are based on the use of a gas water column pressure at the outlet of the meter Table 22 D is based on the use of natural gas having a specific gravity of 0 68 and six inch (6") water column as supplied in the Fort Collins area For undiluted liquified petroleum gas, gas piping may be sized for 2500 BTU/cu ft at eleven inches (11") water column and specific gravity of 1 52 " Section 3 Definitions A Wherever the word "municipality" or "city" is used in the Uniform Mechanical Code, it shall be held to mean the City of Fort Collins B Wherever the word "Building Official" is used in the Uniform Mechanical Code, the term shall be held to mean the City Building Inspec- tor, which term shall be synonymous with the Chief Building Inspector and shall include all his designated representatives Section 4 Penalty Clause The following sections of the Uniform Mechanical Code contain a penalty clause which is herewith set forth in full as required by 31-16-204 of the Colorado Revised Statutes, 1973, as amended, and Article 2, Section 7 of the Charter of the City of Fort Collins, to-wit "Section 202 It shall be unlawful for any person, firm or corporation to erect, install , alter, repair, relocate, add to, replace, use, or maintain heating, ventilating, cooling or refrigeration equipment in the jurisdiction, or cause or permit the same to be done, contrary to or in violation of any provisions of this Code Maintenance of equipment which was unlawful at the time it was installed and which would be unlawful under this Code if installed after the effective date of this Code, shall constitute a continuing violation of this Code Any person, firm or -3- corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is commit- ted, continued, or permitted, and upon conviction of any violation, such person shall be punishable by a fine of not more than Three Hundred Dollars ($300 00), or by imprison- ment for not more than six (6) months, or by both such fine and imprisonment " Section 5 Copies on File At least three (3) copies of the Uniform Mechanical Code, 1979 Edition, shall be on file in the Office of the City Clerk of the City of Fort Collins, Colorado, at least fifteen (15) days preceding the date set herein and may be inspected by any interested persons during normal business hours After the public hearing thereon and final reading and adoption by reference, the Mechanical Code as finally adopted shall be available for sale to the public through the Office of the City Clerk at a price not to exceed the City's actual costs Section 6 Repealer Sections 75-1 through 75-7 of the Code of the City of Fort Collins are hereby repealed, provided, however, that the repeal of said ordinance shall not revive any other section of any ordinance or ordinances heretofore repealed or superceded, and provided further that such repeal shall not make lawful any violation of the ordinances hereby repealed occurring before the effective date hereof, and provided further that the construction under any building permit heretofore taken out under the ordinance herein repealed may be continued in conformance with such repeal- ed ordinance or, if the owner thereof elects, in conformity with the ordinance herein enacted Introduced, considered favorably on
