BEING AN ORDINANCE AMENOTNG SECTION 99-4
OF THE CODE OF THE CITY OF FORT COLLINS
PROVIDING FOR THE INCLUSION OF ACKNOWLEDGEMENT
BY ALL OWNERS AND PROPRIETORS OF PROPERTY TO
BE PLATTED
WHEREAS, Colorado Revised Statutes, 31-23-104 provides that all plats
shall be acknowledged in the manner of a deed by the owners and proprietors
of the lands designated upon any such plat before some officer to take the
acknowledgement of deeds, and
WHEREAS, Colorado Revised Statutes, 31- 23-111 provides that any
person having a legal or equitable interest in any land shall be deemed an
owner and proprietor, and
WHEREAS, the City's present ordinance makes provision only for a
statement of land ownership by the subdivider and a certification of said
statement of land ownership by a licensed attorney, and
WHEREAS, it is determined by the Council of the City of Fort Collins
that the Code of the City should be amended to more precisely comply with
the Colorado Revised Statutes
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows
Section 1 That Section 99-4 C (3) (j ) of the Code of the City of
Fort Collins be, and it hereby is, amended to read as follows
"(j ) An acknowledgement in the manner of a deed by the owners and
proprietors ( legal or equitable interest holders) of the lands
designated upon the plat before an officer authorized to take
the acknowledgement of deeds "
Section 2 That Section 99-4 C (4) (b) of the Code of the City of
Fort Collins be, and it hereby is, amended to read as follows
"(b) Certification of title by a licensed attorney to the effect that
the acknowledgement by the owners and proprietors contained on
the plat is true and correct and represents all owners and
proprietors of record "
Introduced, considered favorably on first reading, and ordered pub-
lished this 21st day of October 1980, and to be resented for
