BEING AN ORDINANCE VACATING THE RIGHT OF WAY
DEDICATED TO THE CITY OF FORT COLLINS BY
DEDICATION DEED RECORDED IN BOOK 1884 AT PAGE
228 OF THE LARIMER COUNTY RECORDS

WHEREAS, heretofore a right of way was dedicated to The
City of Fort Collins for a public road by dedication deed
recorded in Book 1884 at Page 228 of the Larimer County
records over and across the property therein described, and -
WHEREAS, the description contained in such dedication
deed was incorrect and did not describe the property intended,
and
WHEREAS, the right of way over the land intended and
actually used for a road has been dedicated to The City of
Fort Collins on the Plat of Edora Acres, Third Filing, and
by a dedication deed from Maurice L Deines, and
WHEREAS, the property dedicated to The City of Fort
Collins by dedication deed recorded in Book 1884 at Page 228
of the Larimer County records is not used nor intended to be
used for municipal purposes and the description therein
contained is not correct _
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF FORT COLLINS that the right of way dedicated to The
City of Fort Collins by dedication deed recorded in Book
1884 at Page 228 of the Larimer County records be and the
same hereby is vacated, abated and abolished
Introduced, considered favorably on first reading, and
ordered published this 15th day of May 1979, and
to be presented for final passage on the 5th day of
June 1979
