ORDINANCE NO 71 , 1979
BEING AN ORDINANCE AMENDING CHAPTER 93
OF THE CODE OF THE CITY OF FORT COLLINS
RELATING TO THE AUTHORITY OF THE STORM DRAINAGE BOARD
TO CONSIDER VARIANCES AND APPEALS FROM CHAPTER 52
OF THE CODE OF THE CITY OF FORT COLLINS
RELATING TO FLOOD HAZARD AREAS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that
Section 93-5 of the Code of the City of Fort Collins be, and the same
hereby is, amended by the addition of the following subsection
"(D) The Board shall consider all variances and appeals
from the application of the provisions of Chapter
52, Flood Hazard Areas
1 Persons desiring to appeal a decision of
the Director of Public Works to the
Board shall , at the time of making such
appeal , pay to the Director of Finance a
docket fee in the amount of TWENTY-FIVE
DOLLARS ($25 ) Written notice of
hearing shall be given to all parties
concerned at least three (3) days prior
to the hearing or by mailing the same to
such party' s last known address by
regular mail The Board shall from time
to time adopt such additional rules and
regulations as it deems necessary and
advisable for the conduct of its hear-
ings and for carrying out the provisions
hereof
2 Any person in interest shall have
the power to appeal the decision of
the Board to the City Council , provided
that such person in interest files with
the City Clerk a notice of appeal within
ten ( 10) days after final action by
the Board In the event of any such
appeal , the City Council shall schedule
a date for hearing the appeal and shall
give the party making the appeal at
least three (3) days advance notice of
the time and place of hearing The
Council shall consider the same factors
on appeal as considered by the Storm
Drainage Board as set forth in Section
52-5(A)(3) The decision of a majority

of the City Council present at a duly
constituted meeting of the City Council
shall be determinative of this appeal "
