BEING AN ORDINANCE ESTABLISHING AN INTERIM
STCRii DRAINAUE UTILITY FEE PURSUANT TO §93-7
OF THE CODE OF THE CITY OF FORT COLLINS
WHEREAS, there was established in 1976 a comprehensive program provid-
ing for thedrainage and control of flood and surface waters within the
City, and \
WHEREAS, thi's program requires that drainage basin studies be con-
ducted by the Storm Drainage Board and a recommendation for a master
drainage plan be made to the City Council , and
WHEREAS, a numbe\of studies have peen conducted which demonstrate the
feasibility of a city-wide storm drairi ,e program, the most recent being in
April , 1978, and
WHEREAS, notfn thstandinq the fact individual basin studies have not
yet been completed, it is imperative the City proceed with the planning,
design, construction, upgrading and operation and maintenance of a Storm
Drainage Utility in order to provide for and advance the general 4elfare
ana protect the community from the dangers of flooding, and
l'HEREAS, the City Council recognizes tnat improvements installed in
conjunction with previous storm drainage iioprovement districts and with
recent subdivisions r,ere for the purpose of handling minor floes and are
not sufficient to protect these areas from the effects of major flot,s,
and
11HEREAS, the City Council recognizes that it is impossible to remove
all ireguities with respect to credit for the cost of installation of the
existino storm drainage improvements \
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITE OF FORT
COLL INJ
Section 1 That the title of Section 93-7 of the Code of the City of
Fort Collins be, and it hereby is, amended to read as tollows
"STORM DRAINAGE UTILITY FEE "
Section 2 That notwithstanoinq the provisions of Section 93-7 of the
Cooe of the City of Fort Collins coricernino the establisrimert of storm
drainage basins and the receiving of specific basin reports from tree
Storm Drainage Board, there is lereby established an Interim Storm Drainage
Utility Fee to be applied to the City at large and all of its environs for
tie purpose of acquiring, de-,ioning, constructing, upgrading and operating
and maintaining a Stor ,t Drainage Utility within the City of Fort Collins

Section 3 At such time as the .,aster Drainage Plan contemplated by
Chapter 93 of the Ccde of the City of Fort Collins is completed, the Storm
Drainage Utility Fee established by this Groinance may be adjusted to
reflect the true costs of the construction, operation and maintenance of
needed Storm Drainage facilities within the City
Section 4 That trie Interim Storm Drainage Utility Fee is hereby
established at $1 50 per month per basic residential service unit (single
family, 7,500 square feet to 8,000 square feet) with 2,500 square feet of
impervious area For all other classes of property in the City the fee
shall be $1 50 per 2,500 square feet of impervious area
Section 5 That the said fees shall be collected with the monthly
utility bill for tnese utilizing city utilities and billeo alone as storm
drainage charges for those users not utilizing other City utilities
Section 6 Such charges shall be paid monthly by those liable there-
for and placed in a Storm Drainage Fund into which all of said charges so
collected shall be deposited and kept as a fund to be used only for the
purposes stated herein
Section 7 The city shall develop and adopt policies, standards, and
financial incentives to promote, regulate and administer the City's Storm
Drainage Utility
Section 8 Every person subject to a charge provided herein snall pay
the same, when due, to the City of Fort Collins
Section 9 Any charge due hereunder which shall not be paid when due
may be recovered in an action at law by the City of Fort Collins
Section 10 In adoition to any other remedies or penalties provided
by this o- any otner ordinance of the City of Fort Collins, failure of any
user of water or electric service within the City of Fort Collins to pay
said charges promptly when due shall subject such user to discontinuance of
water cr electric service and the City Panaaer of the City is hereby
empowerea and directed to enforce this provision as to any and all aelin-
quent users The employees of the City shall at all reasonable times have
access to any premises served by the City for inspection , repair or the
enforcene it of the provisions of this Oi di nonce
